2. (기밀) 서울중앙지방검찰청은 한나라당 대선 선두 후보 이명박이 BBK 자산관리회사를 김경준과 (크리스토퍼 김으로도 알려짐) 공동 소유했다는 혐의를 입증할 증거가 없다가 오늘 발표하였다. 한 고위 검사는 이명박이 김경준과 공모해 주가를 조작했다는 증거가 없다고 말했다.

(기밀) 이런 발표는 이명박의 죄상에 의지해서 그들의 지지율 고양을 기대했던 여타 후보들에게는 안 좋은 소식이다. 대통합민주신당 정동영 진영은 BBK 발표가 나오길 기다리는 듯 보이는 부동층 유권자의 25% 정도를 규합할 것으로 확신한다고 누누이 정치 참사관들에게 말해왔다. 최근 KBS 여론조사에서 3위로 하락하기 전까지 굳건한 2위를 고수한 보수 이회창 무소속 후보가 막판에 출마하면서 역설한 이명박이 추문에 연루되는 경우에 보수진영에 대체 후보가 필요하다는 말은 그 타당성이 입증되었다. 이제 이명박의 혐의가 일축되면서, 일부 이회창 지지자들은 다시 한나라당 후보로 갈아탈 공산이 커졌다. 11월 5일 KBS 여론 조사에서 이회창이 근 한 달간 2위 자리를 확고히 지킨 이후에 3위로 떨어지자 (이명박 42.1%; 정동영 18.9%; 이회창 18.2%) 일부 이회창 지지자들이 벌써 떠나기 시작했다.

4. (기밀) 지난주 이후 검찰은 이명박이 BBK 관련 혐의를 벗어날 거라는 신호를 보내고 있었다. 임박한 검찰의 발표로 말미암아 국민중심당 심대평 후보가 이회창 후보와 단일화하고, 정몽준이 이명박과 합류하는 등 여러 부산한 이합집산을 촉발하였다. 또한, 다양한 민주당 의원들과 관계자들이 이탈하면서 이회창을 지지하거나 이명박 지지를 서약하였다. 또한, 문국현 후보는 정동영과의 단일화 의향을 발표하였다.
 

5. (기밀) BBK에 희망을 걸고 있었을 다른 후보들은 사건을 살려두려고 애쓰고 있지만, 아마도 별 충격파는 없을 것이다. 대통합민주신당은 만일 검찰이 “정치적인 고려” 때문에 전체 조사 내용을 공개하지 않았다면, 정당차원에서 특별검사 설치를 추진하겠다고 발표하였다. 국회가 휴회 중인 가운데, 대선을 앞두고 그런 협박을 실행에 옮길 가능성은 높지 않다.

(기밀) 그렇긴 하지만, 여당인 대통합민주신당은 특별검사에게 추가적인 조사를 제청하는 법안을 오늘 발의했지만, 11월 19일 대선에 영향을 미칠 공산은 크지 않다. 이런 특검 법안이 통과되려면 국회는 반드시 임시국회를 열어야 하는 데, 이는 대선을 앞두고 사실상 불가능하다. 또한, 동 법안이 법제사법위원회를 통과할 가망성이 거의 없어, 동 법안이 국회의장에 의해 본회의에 직접 상정되어야 할 것이다. 대선 이후에 예산안과 여타 계류 중인 법안을 처리하기 위해 임시국회가 있을 공산이 있지만, 국회의장이 직권 상정해 표결해 부치더라도 본회의를 통과하기 어려울 것이다.

(기밀) 김경준의 누나 에리카 김은 검찰 조사내용을 반박하는 기자회견을 미국에서 열 예정이다. 김씨 가족은 김경준의 자필 메모를 역시 공개했는데, 그 메모에는 만일 김경준이 이명박의 BBK 추문 연루 사실을 부인한다면 김씨의 형량을 감형해주기로 합의했다는 내용이 적시되어 있다. 검찰은 그런 거래 사실을 부인하면서, 거래를 시도한 쪽은 김경준 본인이라고 말했다. 검찰은 김경준이 자신을 본인을 변호하기 위해 제출된 이명박이 BBK 소유주임을 “입증”하는 계약서는 위조됐다고도 선언하였다. 김경준 남매는 수차례 걸쳐 충분한 거짓 증언을 해서 사람들이 남매 누가 됐든 추가적인 혐의 제기에 관심을 기울일 공산은 크지 않다.  

8. (기밀) 이제 이명박이 BBK 관련 혐의를 벗었고, 그가 차기 한국 대통령이 되지않는 다는 각본은 상상하기 힘들다. 후보자와 국회의원들이 서로 합치기 위한 이합집산은 이미 많은 사람이 이번 대선은 이명박에게 넘어갔다고 인정했음이 명징해졌고, 이제는 2008년 4월 국회의원 선거 출마, 더 나아가서는 2012년 대선 가도를 위한 최상책을 찾는 중이다.

¶1. (C) Summary: On December 5, the Prosecutor's Office
announced that Lee Myung-bak was clear of suspicion in the
BBK stock manipulation scandal. While the United New
Democratic Party (UNDP) and others have vowed to continue to
fight to unearth Lee Myung-bak's connection to the scandal,
the official announcement by the Prosecutor effectively means
the end of BBK until after the presidential election. More
importantly, the announcement should take the wind out of
independent candidate Lee Hoi-chang's sails. UNDP candidate
Chung Dong-young has pinned his hopes on unifying liberal
candidates and connecting Lee Myung-bak to BBK. With one of
his key goals out the window, Chung must now focus his
efforts on trying to finish ahead of Lee Hoi-chang. Lee
Myung-bak, who already enjoyed a 20 percentage point lead
over the next most popular candidate, is likely to show even
stronger poll results, making his win all but decided. End

Lee Myung-bak Cleared

¶2. (C) The Seoul prosecutor's office announced today that
they found no evidence supporting allegations that Grand
National Party (GNP) candidate and presidential frontrunner
Lee Myung-bak co-owned the BBK asset management company with
Kim Kyung-joon (aka Christopher Kim). A senior prosecutor
said there was no proof that Lee rigged share prices in
collusion with Kim.

No Hope for Other Candidates

¶3. (C) The announcement is bad news for the other candidates
who counted on Lee's culpability to boost their own support
ratings. UNDP candidate Chung Dong-young's team has
repeatedly told poloffs that Chung was sure to attract some
of the 25 percent of undecided voters who seemed to be
waiting for the BBK announcement to commit. Conservative
independent candidate Lee Hoi-chang -- who had a strong hold
on second place until the latest KBS poll where he dropped to
third -- justified his late entrance into the race citing the
need for an alternative conservative candidate in the event
Lee Myung-bak was implicated in the scandal. Now that the
allegations have been dismissed, some Lee Hoi-chang
supporters will likely switch their support back to the GNP
candidate. A December 5 KBS poll showed some Lee Hoi-chang
supporters have already started to leave as he fell to third
place in that poll (Lee Myung-bak, 42.1 percent; Chung
Dong-young 18.9 percent; Lee Hoi-chang 18.2 percent) after
holding a firm grasp on second place for over a month.
 
¶4. (C) Since last weekend, the prosecutor's office had been
signaling Lee Myung-bak would be cleared of BBK-related
charges. The impending announcement spurred a flurry of
mergers with People's First Party candidate Shim Dae-pyoung
joining Lee Hoi-chang and Chung Mong-joon joining Lee
Myung-bak. Also various Democratic Party lawmakers and
officials split off and pledged support for either Lee
Hoi-chang or Lee Myung-bak. Also, Moon Kuk-hyun announced
his intention to merge with Chung Dong-young.

Efforts to Keep BBK Alive

¶5. (C) The other candidates, who seem to have pinned their
hopes on BBK, will try to keep the issue alive, but probably
without much impact. The UNDP announced that if the
prosecution does not reveal the full report of their
investigation because of "political considerations," the
party will push for the establishment of an independent
counsel. With the National Assembly in recess, it is
unlikely the party will be able to make good on that threat
before the election.
 
¶6. (C) Despite this, the pro-government UNDP put a bill
forward today requesting an independent counsel to
investigate further, but it is unlikely to affect the
December 19 election. For such a bill to pass, the National
Assembly must open a special session, which is virtually
impossible before the election. Also, the bill has almost no
chance to pass the Legislative and Judiciary Committee so the
bill would have to be brought directly to plenary by the
Speaker of the Assembly. While a special session is likely
to occur after the election to deal with the budget and other
pending bills, it would be difficult for it to pass the
plenary even if the Speaker brought it to a direct vote.
 
¶7. (C) Erica Kim, Kim Kyung-joon's sister, will hold a press
conference in the U.S. refuting the prosecutors' findings.
The family also released a hand-written note, written by Kim,
saying prosecutors agreed to commute his sentence if he
denied Lee's involvement in the scandal. The prosecutors
denied such a deal ever existed and said it was Kim who tried
to make a deal. The prosecutor's office also declared that
the contract "proving" Lee's ownership of BBK that Kim
Kyung-joon presented in his defense was forged. The Kim
siblings have cried wolf enough times that people are
unlikely to pay attention to further allegations by either
Kim.

¶8. (C) Now that Lee Myung-bak is clear of BBK-related
charges, it is hard to imagine a scenario in which he will
not be the next president of Korea. The mad scramble by
candidates and lawmakers to merge with each other emphasizes
many have conceded this election to Lee Myung-bak and now are
looking for the best way to set themselves up for the April
2008 National Assembly elections or even the next
presidential election in 2012.
