개별 쟁점 사안과 한미 FTA




한미 FTA에서 미국과 한국의 협상가들은 다수의 개별 쟁점 사안을 다루었다. 예로 대부분의 공산품에 대한 관세 철폐와 같은 일부 쟁점 사안은 매우 논란거리가 아니었으며, 협상 초기 단계에서 처리되었다. 다른 쟁점 사안 예로 농산물과 자동차 무역과 같은 문제는 가장 어려운 협상이었으며, 2007 협상의 최종 시간까지 완료되지 못했다. 양측은 2007년 6월 30일에 동 협정문에 서명했다. 2010년 12월 3일 미국과 한국의 협상가들은 일부 자동차 업종 종사자와 미 의회의 의원들이 제기한 우려를 불식하기 위해 자동차 무역에 주로 속한 한미 FTA에 적시된 약정 사항 일부를 수정하기로 합의하였다.


농업과 위생, 식물위생 쟁점


개요




한국의 거대 시장에 대한 미국 농산물의 포괄적인 접근성을 확보하고, (가장 최근에 2003년 미국 소 무리 중에 광우병이 발견됨에 따라 인간의 건강을 보호하기 위해 가해진) 미국산 쇠고기 구입에 대한 한국의 계속되는 제약들을 해결할 방안을 강구하는 일이 미국 농업 협상가들이 추구하는 두 가지 주요한 목적이다. 한국은 세계적으로 앞서가는 농산물 수입 국가로 꼽히고 있지만, 한국의 농업 부문은 높은 관세와 할당량으로 크게 보호받고 있다.1) 이런 실정은 농부의 오랜 정치적 영향력에 녹아 있으며, (특히 쌀 생산자들의 영향) 도시 인구가 시골과 연결되는 뿌리 깊은 관계를 반영하는 것이다.

2007년 4월 1일에 한미 자유무역협정을 체결함으로써, 미국은 거의 모든 미국 농산물과 식품의 한국시장 진출을 위해 완전한 접근성을 확보했다. 그러나 (기술적으로 한미 자유무역협정에 속해 있지는 않지만, 고위급 논의에 대상이었던) 쇠고기 문제의 돌파구가 2008년 6월까지 마련되지 않았다. 이런 실정은 부시 대통령이 한미 FTA를 미 의회에 제출하기에 앞서 미국산 쇠고기 수입에 적용되는 규칙을 상술하는 합의가 마련되어야만 한다는 당시 새로 선출된 이명박 한국 대통령의 견해에 반영되어 있다. 의회의 몇몇 의원들은 미 의회가 한미 FTA를 고려 혹은 승인하기에 앞서 한국이 과학적인 국제 준칙(準則)에 따라 미국산 쇠고기 시장을 전면 재개방하고, 이에 더해 상업적으로 유의미한 물량에 반드시 합의해야만 한다고 수 개월간 밝혀왔다. 동 협정이 생산자에게 잠재적 이득이란 걸 잘 알고 있는 미국 농민 단체는 당시 동 협정 지지의 조건으로 미국산 쇠고기 수출 재계를 내걸었었다.

가장 최근 남아 있는 FTA 문제를 해결하기 위한 2010년 말 협상에서 오바마 정부나 일부 미 의원들이 추구한 바대로 한국의 미국산 쇠고기 전면 개방이란 결과를 거두지 못했다. 한미 FTA 농업 조항들에 취해진 유일한 변동 사항은 한국이 미국 통상 대표부가 목표한 자동차 조항을 변경해주고, 이에 보답으로 한국이 (여러 가지 요구 중에) 요구한 한 가지 양보 사항이었다. 미국은 다양한 범주의 미국산 돼지고기 수입에 대한 한국의 관세 유예 기간을 2년 더 연장하기로 하였다. 해당 회담의 결과에 호응하여 미국산 쇠고기와 돼지고기 부문 관계자들은 한미 FTA에 대한 지지 의사를 표시하면서, 협상의 이득을 현실화하기 위해선 한국과 다른 국가 사이 FTA가 발효되기 전에 가능한 빨리 승인하는 일이 필수적이라고 강조하였다.

2010년 한국에 대한 수출 총매출이 53억 달러에 달하면서 한국은 다섯 번째로 큰 미국의 농산물 시장이었다. 한미 FTA 농업 조항에 따라 한국은 미국 농산물 수출의 거의 3분의 2에 대해 무관세 지위를 부여하게 된다. 여타 모든 농산물에 관한 관세와 저율관세할당은2) 10년 안에 단계적으로 폐지될 것이며, 극소수 농산물과 식품들은 해당 보호가 2023년까지 단계적으로 폐지하는 조항에 구속받게 될 것이다. 7개의 미국 상품 (탈지분유 및 전지분유, 연유, 제철 오랜지, 식용 감자, 벌꿀, 그리고 완전한 형태의 식용 대두)은 한국의 수입 할당량에 구속을 받되 천천히 계속해서 (할당량이) 확대될 것이다. 그러나 한미 FTA 협정은 미국 쌀과 쌀 제품의 추가적인 한국 시장 진출을 제공하지 않는다.(아래를 보라)3)


저율관세할당이란?“저율관세할당(Tariff Rate Quotas, TRQ)이란 일정 수입량은 무관세 혹은 저율의 관세를 부과하고, 이를 초과하는 물량은 높은 관세를 부과하는 것을 말한다. 양허된 시장접근물량은 저율의 관세를 부과하고 이를 초과하는 물량에 대해서는 높은 관세를 부과할 수 있도록 한 일종의 이중관세제도라 할 수 있다. 저율관세할당은 저율관세할당 물량, 관세율 쿼터, 시장접근물량 등으로 불리우기도 한다. 농산물의 경우 저율관세 할당이 증가하면 그 만큼 저율의 관세가 부과된 수입농산물의 양이 증가하기 때문에 논란이 일기도 한다. 일반적으로 저율관세할당은 계절관세와 더불어 자국 농산물을 보호하기 위한 조치로 알려져 있다.” 외교통상부


한미 자유무역협정에 따른 한국의 상대적으로 높은 무역 장벽의 대부분이 단계적으로 폐지되거나 혹은 즉각 철폐됨으로 미국 농업과 식품 가공 부문이 괄목할 만한 추가 수출 혜택을 누릴 것이다. 미국국제무역위원회는 한미 자유무역협정이 전면 구현되면 미국의 농산물과 가공 식품의 수출 증가량이 미국의 전체 한국 수출량 대비 전체 예상 증가량의 3분 1에 달할 것이다. 농산품의 판매는 동 협정이 없을 경우와 비교해 미화 19억 달러~38억 달러 수출이 증가할 것이다. 이 수출 증가의 거의 절반은 미국산 쇠고기 부문에서 발생하는데, 이는 미국 쇠고기 수출이 2003년 말에 한국이 수입 제약이 가해지기 이전 수준으로 미국산 쇠고기 수출이 회복된다는 미국국제무역위원회의 추산에 기초한 것이다. 약 20%의 수출 증가로 미국의 돼지고기 수출업자, 양계, 여타 육류 생산자들이 해택을 누릴 것이다.4) 다른 분석으로는 미국농민연맹은 한미 FTA가 없을 때와 비교해 (저율관세할당) 전환기가 끝나는 2027년까지 미국 농산물 수출이 15만 달러 이상, 달리 말해 45% 증가할 것으로 전망한 바 있다. 동 협정에 따른 쇠고기, 가금류 고기, 돼지고기의 매출 증가가 미화 6억 4,400만 달러 다른 말로 42%를 차지할 것이다.5)

한국의 대미 농산물 수출은 2010년에 2억 9,800만 달러로 소규모이고, 대개 상보적 관계라 미국 시장 진출 협상에서 논란이 전혀 없다. 미국은 최대 15년까지 7단계의 단계적 철폐 기간에 따라 모든 한국 농산물 수입에 대한 관세와 할당을 단계적으로 폐지하기로 합의하였다. 한 차례의 10년 저율관세할당이 우유와 크림, 여타 특정 유제품 등에 적용될 예정이다. 미국국제무역위원회는 한미 FTA가 없을 경우와 비교해 주로 한국산 가공 식품 부문의 농산물 수입이 5,200만 달러에서 미화 7,800만 달러로 (12%~18%) 증가할 것이다.


쇠고기


시장 접근성




한미 FTA에 따라 한국은 미국산 쇠고기 살코기에 대한 40% 관세를 15년간에 걸쳐 철폐하기로 합의하였다. 또한, 한국은 미국산 쇠고기 수입이 특정 범위를 초과해 급속히 증가할 경우에 대응하여 일시적 긴급수입제한조치를 강제할 권리를 갖는다. 이런 추가 관세를 적용할 임계량은 시행 1년째는 27만 톤으로, 이는 매년 2% 증가한다; 시행 15년째에는 임계량이 35만 4천 톤이 될 것이다.6) 16년째에는 이런 보호 메커니즘이 더는 적용돼지 않을 것이다. 쇠고기 잡육(雜肉) (혀, 간, 꼬리, 발) 등에는 18% 수입 관세가 적용되며, 여타 쇠고기 제품은 22.5%~72% 범위의 관세로 15년 이후에 철폐 될 것이다.

한국이 미국산 쇠고기에 대한 제약을 완전히 철회하고 양국의 쇠고기 무역이 정상화된다는 가정에 기초해 미국국제무역위원회는 한국의 쇠고기 관세 및 긴급제한조치의 단계적 폐지로 말미암아 미국산 쇠고기 수출액이 미화 6억 달러에서 거의 18억 달러로 합의문이 없을 경우에 비해 58%에서 165%를 상회할 정도로 증가될 것으로 평가했다. 미국농민연맹은 한미 자유무역협정에 따라 과거 한국 시장 점유율을 다시 탈환한다면 미국산 쇠고기 매출이 2억 6,500만 달러에 달할 것으로 전망하였다. 그러나, 미국농민연맹의 분석은 미국산 쇠고기의 시장 점유율이 시간이 경과하면서 증가세가 둔화된다고 지적한다. 그 이유는 미국농민연맹에 의하면 한국 사람의 입맛이 풀을 먹고 자란 호주산 쇠고기 길들여져 있기 때문이며, 현재 40%의 관세가 제거되도 호주산 쇠고기가 가격 면에서 미국산 쇠고기를 상대로 경쟁력이 여전할 것이기 때문이다.


위생조건




2008년 4월 18일 미국과 한국 협상자들은 한국이 미국산 쇠고기 수입에 적용할 위생조건에 대해 합의하였다. 4월 18일 협상으로 광우병을 전염시킨다는 특정위험물질이 제거되고 여타 조건에 부합하는 이상 월령에 상관없이 미국산 쇠고기의 뼈없는, 뼈있는 모든 부위와 여타 쇠고기 제품의 수입을 허가되었다. 그러나 한국의 추가적인 우려를 해소하기 위해 쌍방은 2008년 6월 21일 동 합의를 수정하여 30개월 령 미만 소에서 나오는 쇠고기로 판매를 제한하였다.

한국은 신속히 동 합의가 발효되도록 위생조건을 고시했으며, 미국산 쇠고기의 적하물을 검사하기 시작하였다. 미 농무부는 유사하게 30개월령 미만 소를 가공해 판매되는 쇠고기를 검증하기 위한 새로운 프로그램을 구현하기 시작하였다. 미국산 쇠고기 수출업자들은 그간 주요 해외 시장을 재탈환하기 위해 노력해왔다.

처음으로 광우병이나 소해면상뇌증에 감염된 미국산 소가 발견된 이후 금수조치 처분을 받기 이전인 2003년도에 한국은 세번 째로 큰 미국산 쇠고기 수출 시장이었다. 한미 FTA에 대한 심사와 지지 여부는 한국이 미국산 쇠고기 시장을 전면 개방하는 냐에 달려 있다는 몇몇 미 국회의원들의 입장에서 한국의 상업적 중요성은 잘 드러나 있다.

미국산 쇠고기 산업과 미국 정책 입안자들은 4월 첫 협상을 환영했지만, 미국산 쇠고기의 안전성에 의문을 제기하는 한국의 동 문제에 대한 TV 보도와 인터넷에 퍼진 소문으로 쇠고기 합의를 제협상하거나 폐기를 요구하는 시위가 급증하는 결과를 초래하였다. 미국 당국자들은 소해면상뇌증이 미국 소 무리로 유입되지 않도록 이미 마련한 조치들이 국제 과학 준칙에 부합한다고 반박한 바 있다. 거세지는 국민적 압박을 처리하기 위해 한국 정부는 쇠고기 합의의 “재협상” 없이 국민의 우려를 해소하는 방안을 모색하기 위해 미합중국과 두 차례 회담을 추진하였다. 2008년 6월 말에 양국 정부는 한국 업체가 30개월령 미만 소에서만 생산된 미국산 쇠고기를 수입하기로 허가하는 “민간부문의 자발적인” 조치를 공식화했다. 쌍방은 이를 한국 소비자가 미국산 쇠고기의 안전성에 대한 신뢰를 회복할 때까지 과도기적 조치로 보고 있다.

이러한 약정에 따라 (뼈있는 부위를 포함한) 미국산 쇠고기 한국 수출이 2008년 중순에 재개되었고, 그 해 말 매출이 거의 미화 3억 달러에 달하면서 2003년 판매 수준의 3분에 1을 상회하였다. 2009년 경제 침체로 인한 전 세계적인 쇠고기 판매가 감소하면서 미국산 쇠고기 한국 판매가 미화 2억 1,600만 달러로 감소하였다. 2010년은 전년도에 비해 2배 이상 증가한 5억 1,800만 달러에 달했다.7) 비록 호주가 주요 경쟁자지만, 미국산 쇠고기 수출업자들은 한국 시장이 재개방된 이래로 주목할 만한 시장 점유율을 확보했다. (양적인 측면에서) 미국의 점유율은 2008년 15%에서 2009년에 26%, 2010년에 32%까지 (2003년에 69%와 비교해) 증가하고 있다. 미국산 쇠고기에 대한 소비자의 신뢰를 제고하기 위한 홍보 노력과 대형 체인 매장의 공격적인 마케팅 노력에 더해 한국산 쇠고기보다 외국산 소매 가격이 훨씬 낮은 까닭에 한국에서 미국산 쇠고기 판매가 계속 성장세에 있다.8)

오바마 대통령이 한미 자유무역협정을 의회에 제출하기로 2010년 6월 26일 발표한 이후에 오바마 정부 관리들은 미 의회와 이해 당사자과 함께하는 협의가 완료되는 2010년 11월까지 한국과 함께 쇠고기와 자동차 문제를 해결하겠다는 의사를 밝혔다. 2010년 12월 3일 타결된 협상에서 쇠고기 문제는 쌍방이 자동차 조항 개정에 초점을 맞춘 관계로 논의가 거의 이뤄지지 않았다고 한다. 오바마 대통령은 부속 합의서 논의에서 미국은 “미국산 쇠고기의 전면적인 한국 시장 진출을 담보”하는 방향으로 계속 일할 예정임을 시사하였다.9)

쇠고기 쟁점의 성과에 대한 미 의회의 반응은 엇갈린다. 국제 과학 준칙에 따라 소의 월령과 무관하게 미국산 쇠고기에 대한 완전한 시장 진출을 옹호하는 상원 재정위 위원장인 보커스 의원은 “한국의 상당한 미국산 쇠고기 수출 장벽을 해소하지 못한” 부속 합의라며 “깊은 실망감”을 표명했다. 그는 “이런 잘못”을 바로잡겠다는 그의 다짐을 표명하면서, 오바마 정부와 협력해서 목장 주인들이 ”뒷전으로 밀리지” 않도록 할 것이라고 했다. 더 최근에 보커스 상원의원은 자신은 한국이 쇠고기 시장을 개방할 때까지 한미 FTA를 찬성하지 않겠다고 밝혔다. 몇몇 다른 상원의원들은 쇠고기 문제의 진척이 더딘 점에 우려하지만, 동 협정을 긍정적으로 보며, 2011년에 한미 FTA (비준)심사 가능성을 환영하였다.10) 정육업 단체들은 시간이 감에 따라 그들의 한국 수출이 상당히 증가할 것을 기대한다며 동 무역 협정에 찬성 의사를 밝힘에 더해 미 의회가 동 협정을 조속히 비준할 것을 촉구하였다. 마찬가지로 찬성하는 쇠고기 이해 당사자들은 전면적인 시장 진출을 담보하도록 지속적인 노력을 주문하였다.11)

2008년 한국에서 발생한 쇠고기 합의 반대 시위의 강도나 규모에 대한 기억이 한국 협상자들이 쇠고기 문제를 대하는 자세에 직접적으로 영향을 미친 것으로 보인다. 한국 협상자들은 이러한 정치적인 민감성을 반영하듯 오바마 대통령과 이 대통령과의 정상회담을 앞두고 열린 11월 초 협상과 부속 합의로 가는 최종 회담에 포함된 쇠고기 문제에 대해 어떤 논의도 거부한 것으로 보고되고 있다. 그들의 입장은 쇠고기 문제가 2007년에 체결된 한미 FTA와는 “별개”라는 것이다. 그 이후에 한국의 통상교섭본부장은 쇠고기 용으로 도축된 미국 소의 월령 제한의 종식과 관련 논의는 더는 없을 것임을 확언하였다. 이런 태도는 가장 최근에 2011년 1월 말에 워싱턴 주재 한국 대사에 의해 확인되었다(주: 연령 제한이 없는 첫 합의에서 변동은 없다는 뜻).12) 그 결과는 한국에서 예정된 한미 FTA에 관한 정치적 토론 내용상에 변동이 없다는 점에서 그간 성공적이었다고 보인다. 그러나 만일 지금의 미국산 쇠고기 시장 진출 조건에 변동이 가해졌다면, FTA 협정문 관련 논쟁으로 번질 틈을 반대파에게 제공했을 것이다.

2011년 5월 4일 미국무역대표부는 한미 FTA 심의를 위해 미 의회에 제출하는 방향으로 좀 더 다가서기 위해 미국산 쇠고기 시장 진출 문제에 관해 두 가지 조치를 발표했다. 보커스 상원에 보내는 서한 내용에는 한미 FTA가 발효되자 마자 미국 정부는 쇠고기 합의 내용의 “전면 구현”과 관련(예로 미국산 쇠고기의 모든 부위와 모든 월령에 대해 한국 시장 개방) 한국과의 협의를 요청하기로 다짐하였다. 동 서한에는 양자 혐의를 요청한 당일부터 “7일 안에 개최하여” 쇠고기 합의 조건의 해석과 적용을 명문화한다는 구체적인 조항 하나를 적시하고 있다. 같은 날에 미 농무부는 회계년도 2011년에만 한국에서 미국산 쇠고기 판매를 촉진하기 위해 사용하도록 미화 백만 달러 포상금을 미국 육류수출협회에 지금하고, 이에 더해 핵심 시장인 한국에서 쇠고기 시장 활성화를 위한 5개년 전략을 구현하겠다는 미국 육류수출협회의 향후 기금 조달 요청을 고려할 뜻도 발표하였다. 보커스 상원의원은 두 가지 조치를 환영하고, 그가 한미 FTA를 찬성하겠다는 의사 표시에 더해 3종 FTA 모두를 포함하는 일단의 무역조치와 무역조정지원제도, 교역특혜프로그램 등을 갱신하는 등에 오바마 정부와 협력하겠다고 언명하였다.

Sector-Specific Issues and the KORUS FTA




Under the KORUS FTA, U.S. and South Korean negotiators addressed a number of sector-specific issues. Some issues, such as elimination of tariffs on most manufactured goods, were not very controversial and were dealt with in early stages of the negotiations. Other issues, such as trade in agricultural products and in autos, were the most difficult and were not completed until the final hours of the 2007 negotiations. The two sides signed the agreement on June 30, 2007. On December 3, 2010, U.S. and South Korean negotiators agreed to modifications to some of the commitments made under the KORUS FTA, that pertain largely to the auto trade, in order to assuage concerns raised by some members of the auto sector and Members of Congress.


Agriculture and Sanitary and Phytosanitary Issues



Overview




Attaining comprehensive market access for U.S. agricultural products to South Korea’s large market and finding a way to resolve Korea’s continued restrictions on U.S. beef purchases (imposed to protect human health following the late 2003 discovery of mad cow disease in the U.S. cattle herd) were the two primary objectives pursued by U.S. agricultural negotiators. Though South Korea ranks among the leading agricultural importing countries in the world, its farm sector is highly protected with high tariffs and quotas.13) This reflects its farmers’ longstanding political influence (particularly that of rice producers) and its urban population’s deep ties to its rural roots.

In concluding the KORUS FTA on April 1, 2007, the United States secured nearly complete access for all U.S. agricultural commodities and food products into Korea’s market. However, a breakthrough on the beef issue (technically not part of the FTA talks but nevertheless the subject of high-level discussions) did not occur until June 2008. This reflected the then newly elected Korean President Lee’s view that an agreement spelling out the rules that apply to beef imports from the United States had to be in place before President Bush would consider sending this agreement to Capitol Hill. Several Members of Congress had for months stated that South Korea must agree to fully reopen its market to U.S. beef under scientifically based international rules and in commercially significant quantities before Congress considers or approves the agreement. U.S. agricultural groups, well aware of this deal’s potential benefits for producers, had then also conditioned their support on the resumption of U.S. beef exports.

More recently, the late 2010 negotiations to address outstanding FTA issues did not result in the full opening of South Korea’s market to U.S. beef as sought by the Obama Administration and some Members of Congress. The only change made to the agreement’s agricultural provisions is a concession (among others) requested by South Korea in return for changes sought by USTR in the auto provisions. The United States accepted a two-year extension in the phasing out of Korea’s tariff on the largest category of pork imports from the United States. Responding to the conclusion of these talks, the U.S. beef and pork sectors have expressed their support for the KORUS FTA, emphasizing that its approval as soon as possible is vital to realizing the gains negotiated before other countries’ FTAs with South Korea take effect.

In 2010, South Korea was the fifth-largest market for U.S. agriculture, as export sales totaled $5.3 billion. Under the KORUS FTA’s agricultural provisions, South Korea immediately would grant duty-free status to almost two-thirds of current U.S. agricultural exports. Tariffs and tariff-rate quotas (TRQs)14) on most other agricultural goods would be phased out within 10 years, with a few commodities and food products subject to provisions that phase out such protection by year 23. Seven U.S. products (skim and whole milk powders, evaporated milk, in-season oranges, potatoes for table use, honey, and identity-preserved soybeans for food use) would be subject to Korean import quotas that slowly expand in perpetuity. However, the agreement does not give U.S. rice and rice products additional access to South Korea’s market (see below).15)

With the immediate elimination or phase-out of most of South Korea’s relatively high agricultural trade barriers under the KORUS FTA, the U.S. agricultural and food processing sectors would noticeably benefit from additional exports. The USITC estimates that the increase in U.S. exports of agricultural commodities and processed foods would account for up to one-third of the entire projected increase in total U.S. exports to South Korea’s market once the KORUS FTA’s provisions are fully implemented. Sale of agricultural products would be from $1.9 billion to $3.8 billion (44% to 89%) higher than exports under a no-agreement scenario. Almost half of this export increase would accrue to the U.S. beef sector, based on the USITC’s assumption that U.S. beef exports recover to the level before South Korea imposed its import restrictions in late 2003. About 20% of the export increase would benefit U.S. producers and exporters of pork, poultry and other meat products.16) In another analysis, the American Farm Bureau Federation (AFBF) projects that U.S. agricultural exports by the end of the transition period (2027) would be more than $1.5 billion (45%) higher under the KORUS FTA than would be the case otherwise. Sales of beef, poultry, and pork would account for $644 million (or 42%) of this increase.17)

Because South Korean agricultural exports to the United States are small ($298 million in 2010) and largely complementary, there was no controversy in negotiating access to the U.S. market. The United States agreed to phase out tariffs and quotas on all agricultural imports from South Korea under seven phase-out periods ranging up to 15 years. One 10-year TRQ would apply to imports of fluid milk and cream, among other specified dairy products. The USITC projects that imports of agricultural products (primarily processed food products) from South Korea under the KORUS FTA would be from $52 million to $78 million (12% to 18%) higher than such imports under a no-agreement scenario.


Beef



Market Access




Under the KORUS FTA, South Korea agreed to eliminate its 40% tariff on beef muscle meats imported from the United States over a 15-year period. Also, South Korea would have the right to impose safeguard tariffs on a temporary basis in response to any potential surge in imports of U.S. beef meats above specified levels. The trigger for this additional tariff would be 270,000 metric tons (MT) in year 1, which would increase 2% annually; in year 15, the trigger would be 354,000 MT.18) In year 16, this protective mechanism would no longer apply. The 18% tariff on imports of beef offals (tongues, livers, tails, and feet), and tariffs ranging from 22.5% to 72% on other beef products, would also be eliminated in 15 years.

Assuming that South Korea fully lifts its restrictions on U.S. beef and bilateral beef trade returns to normal, the USITC estimates that the phase-out of South Korea’s beef tariff and safeguard could increase U.S. beef exports from about $600 million to almost $1.8 billion (58% to 165%) above what would be the case otherwise. Under the KORUS FTA, the AFBF projects that U.S. beef sales would be $265 million higher as the United States recaptures its historic share of the South Korean market. However, its analysis notes that the market share of U.S. beef likely will not increase over time. That is because South Korean tastes have developed a preference for grass-fed Australian beef, according to the AFBF, and will continue to be competitive in price against U.S. beef even with the current 40% tariff removed.


Sanitary Rules




On April 18, 2008, U.S. and South Korean negotiators reached agreement on the sanitary rules that Korea will apply to beef imports from the United States. It allows for imports of all cuts of U.S. boneless and bone-in beef and other beef products from cattle, irrespective of age, as long as specified risk materials known to transmit mad cow disease are removed and other conditions are met. However, to address subsequent Korean concerns, both sides revised this deal on June 21, 2008, to limit sales of U.S. beef from cattle less than 30 months old.

South Korea quickly published rules to put this agreement into effect, and began to inspect U.S. beef shipments. The U.S. Department of Agriculture similarly began to implement a new program to verify that the beef sold is processed from cattle under 30 months old. U.S. beef exporters have since worked to recapture a key overseas market.

In 2003, South Korea was the third-largest market for U.S. beef exports, prior to the ban imposed after the first U.S. cow infected with mad cow disease, or BSE (bovine spongiform encephalopathy), was discovered. Korea’s commercial significance is reflected in the position taken by some Members of Congress, who have stated that congressional consideration of, and support for, the KORUS FTA depends upon South Korea fully opening its market to U.S. beef.

While the U.S. beef industry and U.S. policymakers welcomed the initial April deal, Korean TV coverage of the issue and Internet-spread rumors that questioned the safety of U.S. beef resulted in escalating protests and calls for the beef agreement to be renegotiated or scrapped. U.S. officials countered that measures already in place to prevent the introduction of BSE in U.S. cattle herds meet international scientific standards. To address mounting public pressure, the Korean government twice pursued talks with the United States to find ways to defuse public concerns without “renegotiating” the beef agreement. In late June 2008, both governments confirmed a “voluntary private sector” arrangement that allows Korean firms to import U.S. beef produced only from cattle less than 30 months old. Both viewed this as a transitional step until Korean consumers regain confidence in the safety of U.S. beef.

Under this arrangement, exports of U.S. beef (including bone-in cuts) to South Korea resumed in mid-2008, and by year-end reached almost $300 million, more than one-third of the record 2003 sales level. In 2009, with the drop off in beef sales worldwide due to the economic recession, U.S. beef sales to Korea fell to $216 million. For 2010, sales more than doubled over the previous year to reach $518 million.19) Though Australia is the main competitor, U.S. beef exporters have gained noticeable market share since the Korean market reopened. The U.S. share (in quantity terms) rose from 15% in 2008, 26% in 2009, to 32% in 2010 (compared to 69% in 2003). Promotional efforts to rebuild consumer confidence in U.S. beef, aggressive marketing efforts by large store chains, and much lower retail prices for foreign than for Korean beef, account for the continued growth in U.S. beef sales in Korea.20)

Obama Administration officials, following the President’s June 26, 2010, announcement of his decision to present the KORUS FTA to Congress, stated their intent was to resolve the beef and auto issues with South Korea by November 2010 once consultations with Congress and stakeholders were complete. In the negotiations concluded on December 3, 2010, the beef issue reportedly received little discussion as both sides focused on revising the auto provisions. President Obama, in discussing the supplemental agreement, indicated that the United States will continue to work toward “ensuring full access for U.S. beef to the Korean market.”21)

Congressional reaction on the outcome of the beef issue was mixed. Senator Baucus (chairman of the Senate Finance Committee), who had advocated for full access for U.S. beef irrespective of the age of cattle in accordance with international scientific standards, expressed “deep disappointment” that the supplemental deal “fails to address Korea’s significant barriers to American beef exports.” He stated his commitment to right “this wrong” and to work with the Administration to ensure that ranchers “are not left behind.” More recently, Sen. Baucus said he will not support the KORUS FTA until South Korea opens up its beef market. A few other Senators, though concerned with the lack of progress on beef, viewed the deal positively and welcomed the prospect for considering the KORUS FTA in 2011.22) Meat industry groups expressed support for this trade agreement that they expect over time will significantly increase their exports to South Korea, and urged Congress to move quickly to ratify it. Beef interests, also supportive, called for continued efforts to secure full market access.23)

Memories of the size and intensity of the 2008 anti-beef agreement protests in South Korea appear to have directly influenced the position taken on the beef issue by Korean negotiators. Reflecting this political sensitivity, they reportedly rejected any discussion on this matter in the negotiations held in early November leading up to the summit between Presidents Obama and Lee and in the final talks leading to the supplemental agreement. Their position was that this issue “did not fall under” the FTA concluded in 2007. Since then, South Korea’s trade minister has confirmed that there will be no more discussions on ending the age limits of U.S. cattle slaughtered for beef. This stance was more recently affirmed by its ambassador to Washington in late January 2011.24) The outcome appears to have been successful in that it has not altered the political debate expected to occur in South Korea on the KORUS FTA. However, if changes had been made to the terms of current U.S. beef access, opponents would have been given an opening to shift the debate on the agreement.

Seeking to move closer toward submitting the KORUS FTA to Congress for consideration, the USTR on May 4, 2011, announced two measures to be taken on the U.S. beef access issue. In a letter to Senator Baucus, the Administration committed to request consultations with South Korea on the “full implementation” (e.g., opening Korea’s market “to all ages and all cuts of U.S. beef”) of the protocol as soon as this trade agreement takes effect,. The letter referenced one specific provision that stipulates bilateral consultations on the interpretation or application of the protocol’s terms “shall be held within seven days” of a request. On the same day, USDA announced a $1 million award to the U.S. Meat Export Federation (USMEF) to be used in FY2011 to promote U.S. beef sales in South Korea, and its intent to consider future funding requests from the USMEF to implement its planned five-year market beef promotion strategy in this key market. Senator Baucus welcomed both steps, stating he will support the KORUS FTA and work with the Administration on a package of trade measures that includes all three FTAs and renewing trade adjustment assistance and trade preference programs.

A TRQ is a two-part tool used by countries to protect their more sensitive agricultural and food products, often while transitioning over time to free trade. The quota component provides for duty-free access of a specified quantity of a commodity, which in an FTA usually expands over time. Imports above this quota are subject to a prohibitive tariff that in an FTA frequently declines over time. At the end of a product’s transition period to free trade under an FTA, both the quota and tariff no longer apply (with a few exceptions), allowing for its unrestricted access to the partner’s market.
