의약품과 의료기기는 한미간 무역의 상대적으로 작은 부분에 해당하지만, 이들 상품은 남한 시장에서 미국이 경쟁력이 좋은 상품이다. 또한, 남한 경제가 성숙해짐에 따라 수출의 기회가 확대될 것으로 제조업체들이 예상하고 있다. 수년간 미국 산업계와 정부는 남한의 의약품 정책이 주로 복제약을 생산하는 남한 산업을 보호하기 위해 설계된 것 아니냐는 불평을 해왔다.

남한은 세계에서 12번째 큰 의약품 시장이며, 연간 매출액이 미화 80억 달러에 달한다.1) 남한의 의료기기 시장은 연간 매출액이 대략 미화 25억 달러에 달하며, 앞으로 수년간 매해 10~15% 성장할 것으로 기대되는데, 부분적으로 인구의 빠른 고령화에 기인한다.2) 잠재적으로 수익성이 기대되지만, 미국 의료기기 제조업체들은 한국 정부의 규제로 시장 진출 능력이 제약을 받는 시장이라고 주장한다.

2010년에 미국은 5억 3,800만 미불 상당의 의료기기 및 소모품 한국으로 수출했으며, 미국의 총 의료기기 및 소모품 수출의 2.1%를 차지하며 한국에 대한 미국산 총수출의 1.7%를 차지한다. 2010년에 미국은 8억 2,500만 미불 상당의 의약품 및 약물을 한국에 수출했으며 이는 미국의 총 의약품 수출의 1.7% 차지하고 한국에 대한 총 상품 수출의 2.1%를 차지한다.3) 같은 해에 남한은 1억 9,730만 미불 상당의 의료기기 및 소모품을 미국에 수출했고, 미화 8,090만 미불 상당의 의약품을 수출했다.

또한, 의약품과 의료기기 제조업체들은 단일 의료보험 사업을 따르는 한국의 의약품 및 의료 장비 급여 정책을 이유로 들었다. 미국 제조업체들은 포지티브 리스트 정책이 신약을 차별한다고 주장한다. 왜냐면 해당 의약품에 대해 상대적으로 낮은 보험 급여가 산정되면서 첨단 의약품 생산자에게 발생하는 비용, 그리고 높은 약값에 반영된 비용을 고려하지 않는 것이라고 주장하였다. 제조업체들은 한국 정부가 약값 산정과 급여 정책을 개발하고 실행하기 위한 한미 FTA의 중요한 원칙으로 투명성 확립을 원하고 있다. 미국 제조사의 이익에 반하는 결정에 대한 항소 절차가 이에 포함한다.

그에 따른 대응으로 남한은 미국 의약품 제조사가 안정성과 효능에 기초한 보험 급여 인상을 신청할 수 있도록 한미 FTA에서 합의했다. 또한, 남한은 약값 산정, 보험 급여, 의약품과 의료 기기에 적용되는 법안, 규제, 절차에 관한 제안을 전국적으로 이용이 가능한 발행물의 형태로 고시하고 의견을 개진할 시간도 허용하기로 합의하였다. 이와 아울러 남한은 예고된 법 개정이나 규제 변동 내용에 대해 미국 제조사가 의견을 개진함에 더해 그들에게 불리한 영향을 미치게 될 행정 결정에 대해 검토할 수 있는 절차를 확립하기로 합의하였다.

남한 내 지적 재산권 보호는 미국 의약품 제조사의 중요한 문제이다. 특히 한국 정부는 시장 승인 심사를 위해 반드시 제출해야 하는 특허 자료를 경쟁 업체로부터 보호하지 못했다. 이와 아울러 남한 정부는 일부 사례에서 특허 신청자가 정당한 특허권자이고 상표권자인지 결정하기에 앞서 일부 의약품의 마케팅을 승인한 바 있다.4)

그에 따른 대응으로 남한은 한미 FTA 자료독점권 조항에 따라 복제약 제조업체와 같은 제3의 회사가 시장 승인 심사의 일부로 미국의 원천 제조업자가 공급한 안전성과 유효성 자료를 활용해 신약을 마케팅할 수 없도록 할 것이다. 미국의 원천 제조사의 허락 없이는 원천 상품의 시장 승인 날짜로부터 5년 동안 그런 식의 마케팅은 할 수 없다. 이와 아울러 FTA 당사국 정부가 이미 승인한 제품에 대해 제삼자가 안전성 혹은 유효성 정보를 제출한다면 해당 정부는 원천 특허권자에게 제삼자의 신원을 통지함에 더해 원천 특허권자의 허락 없이는 자국 영토에서 제삼자의 상품 마케팅을 못 하게 한다. 부속 서신에서 미국과 한국은 원래 FTA 발효 18개월이 되기 전까지는 자료독점권 조항을 발동하지 않기로 합의했다. 변경된 약정 사항에 따라 미국은 두 배인 36개월 다시 말해 3년으로 합의했고 이 기간에 남한 정부는 한미 FTA에 따라 요구되는 의약품 허가특허 연계의무를 마련해야 할 것이다. 남한은 더 나아가 허가특허 연계의무; 즉 원천 특허가 여전히 유효한 동안에는 양국 정부 모두 복제약 마케팅을 승인할 수 없다. 특허기간 연장으로 알려진 다른 조항에 따라 각 FTA 당사국은 특허 심사와 마케팅 승인 심사에 따른 지연 기간을 반영하기 위해 각종 의약품 특허에 대한 유효 기간을 조정하게 되어 있다. 한미 FTA는 각 정부의 의약품 접근권을 담보하는 까닭에 후천성 면역결핍증, 결핵, 말라리아, 여타 전염병으로부터 자국 주민을 보호하지 못하도록 막는 조항은 전혀 없다. 한미 FTA는 세계무역기구 TRIPS 협정과 공중 보건에 관한 선언에 대한 각국의 공약을 재확인한다.

한미 FTA에 대한 의약품과 의료기기 산업계의 반응은 다소 엇갈린다. 혁신적인 제품 생산 업체는 특허권자의 권리를 보전하도록 고안된 조항이나 한국의 규제, 약값 산정, 보험 급여 절차가 더욱 투명해지고 의견 개진과 그에 따른 검토 절차가 개방되도록 고안된 조항에 대해 지지했다. 동시에 산업계 대표들은 남한의 새로운 보험 급여 절차에 대해 여전히 비판적이며 새 제도가 약값 상승의 원인이 되는 혁신적인 약의 혜택을 반영하지 않았다고 주장한다. 복제약 제조업체들은 한미 FTA에 저렴한 약에 대한 접근성을 보장하는 조항을 포함하지 않았다고 주장한다.5)

Pharmaceuticals and Medical Devices




While pharmaceuticals and medical devices (P&M) are a relatively small part of U.S.-South Korean trade, they are products in which U.S. producers compete well in the South Korean market and ones in which manufacturers see increasing export opportunities as the South Korean economy matures. For years, the U.S. industry and government have complained about a number of South Korea’s pharmaceutical policies that allegedly are designed to protect South Korean industry, which predominately produces generic drugs.

South Korea is among the world’s top 12 largest markets for pharmaceuticals, accounting for about $8 billion in sales annually.6) The South Korean market for medical devices accounts for roughly $2.5 billion in sales annually and is expected to grow 10%-15% each year in the next several years, in part due to the rapid aging of the population.7) While potentially lucrative, South Korea is a market in which U.S. P&M manufactures claim government regulations have limited their ability to penetrate that market.

In 2010, the United States exported $538 million in medical equipment and supplies to South Korea, accounting for 2.1% of total U.S. exports of those products and 1.7% of total U.S. manufactured exports to South Korea. In 2010, the United States exported $825 million in pharmaceuticals and medicines to South Korea accounting for 1.7% of total U.S. exports of pharmaceuticals and 2.1% of total U.S. merchandise exports to South Korea.8) In the same year South Korea exported $197.3 million in medical equipment and supplies and $80.9 million in pharmaceuticals to the United States.

Of major concern was the South Korean government’s May 2006 change in how it determined reimbursement amounts. Prior to the change, it maintained a “negative list” system, under which products would be eligible for reimbursement unless they appeared on the list. With the change, the South Korean government has switched to a “positive list” requiring a product to be listed before it would be eligible making it potentially more difficult for a product to become eligible. Announcement of the policy came without prior notification to U.S. officials or affected U.S. manufacturers and occurred at an early point in the negotiations placing a cloud over them. Despite complaints from the United States, South Korea went ahead with implementing its positive list system.

P&M manufacturers also have cited the South Korean government’s policies on reimbursements for pharmaceuticals and medical devices under its single-payer health insurance program. U.S. manufacturers have argued that the policies discriminate against innovative pharmaceuticals because they establish relatively low reimbursement amounts for medicines thus not taking into account the costs that producers of leading-edge pharmaceuticals incur and that are reflected in higher prices. The manufacturers wanted the KORUS FTA to establish transparency as an important principal in South Korea’s development and implementation of pricing and reimbursement policies, including an appeal process for decisions going against U.S. manufacturers.

In response, South Korea agreed in the KORUS FTA to allow U.S. pharmaceutical makers to apply for increased reimbursement levels based on safety and efficacy. South Korea also agreed to publish proposed laws, regulations, and procedures that apply to the pricing, reimbursement, and regulation of pharmaceuticals and medical devices in a nationally available publication and to allow time for comment. In addition, South Korea agreed to establish a process for U.S. manufacturers to comment on proposed changes in laws and regulations and for them to obtain a review of administrative determinations that adversely affect them.

Intellectual property rights protection in South Korea has been a critical issue for U.S. pharmaceutical manufacturers. Specifically, the failure of the South Korean government to protect from competitors proprietary data that manufacturers must submit for market approval. In addition, the South Korean government has, in some cases, approved marketing of some pharmaceuticals before it has determined that the applicant is the rightful owner of the patent and trademark.9)

In response, under the KORUS FTA’s data exclusivity provisions, South Korea would not allow a third company, such as a generic drug manufacturer, from marketing a new pharmaceutical using the safety and efficacy data, supplied by an original U.S. manufacturer as part of the market approval process, without the permission of the original U.S. maker for five years from the date of marketing approval for the original product. In addition, if a third party submits safety or efficacy information for a product that an FTA partner government had already approved, the government is to notify the original patent holder of the identity of the third party and is to prevent the marketing of the third party’s product on its territory if permission had not been granted by the original patent holder. In a side letter, the United States and South Korea originally agreed to not invoke the data exclusivity provision until the FTA has been in effect 18 months. Under the modifications to the commitments, the United States agreed to double to 36 months, or three years, the time South Korea will have to put in place a system of patent linkages for pharmaceuticals that is required under the FTA. Furthermore, South Korea agreed to a patentlinkage system; that is, neither government is to approve the marketing of a generic drug while the original patent is still in effect.. Another provision, known as patent-term extension, would require each FTA government to adjust the length of the effective period for patents on pharmaceuticals to take into account delays incurred in receiving patent approval and marketing approval. The KORUS FTA states that no provision would prevent either government from taking measures to protect the public health of its residents from HIV/AID, tuberculosis, malaria, and other epidemics, by ensuring access to medicines. The FTA would reaffirm each country’s commitment to the WTO TRIPS/health Declaration.

Reactions within the pharmaceutical and medical devices industries were somewhat split on the KORUS FTA. Makers of innovative products supported the provisions that are designed to preserve the rights of patent holders and provisions that are designed to make the South Korean regulatory, pricing, and reimbursement process more transparent and open to comments and procedural reviews. At the same time, industry representatives remain critical of South Korea’s new reimbursement procedures and argue that the new system does not take into account the benefits of innovative drugs that cause drug prices to be higher. Generic drug manufacturers argue that the KORUS FTA does not contain provisions guaranteeing the availability of affordable drugs.10)
