문재인 정부에 대한 노동자들의 기대감이 높은 상황이다. 노동계는 보수정권 아래에서 정부가 재벌그룹 중심의 정책을 펴면서 상대적으로 노동계가 피해를 입었다며 정부가 친노동 정책을 펼쳐나갈 것을 기대하고 있고, 정부도 적극적으로 노동계의 요구를 수용하고 있다.

한국노동조합총연맹(한노총)과 전국민주노동조합총연합회(민노총) 등 양대노총이 문재인 정부를 향해 국제노동기구(ILO) 핵심협약 비준과 함께 노동조합및노동관계조정법 전면 개정을 촉구하고 있다.

1991년 ILO 가입 후 26년이나 지체된 국제노동기구 핵심협약 비준을 이제는 미룰 수 없다는 것이다.

한국 정부는 현재 8개 ILO 핵심협약 중 △결사의 자유 및 단결권 보호에 관한 협약(87호) △단결권 및 단체교섭권 원칙 적용에 관한 협약(98호) △강제노동에 관한 협약(29호) △강제노동 폐지에 관한 협약(105호) 등을 비준하지 않고 있다. 현재 ILO의 187개 회원국 중 4개 협약을 비준하지 않은 나라는 한국, 중국 등 5개 나라에 불과하다.

노동계는 실업자와 해고자, 특수고용 노동자 등 노동조합의 보호를 가장 필요로 하는 이들은 단결권을 행사할 수 없고, 소방 공무원을 비롯한 많은 공무원들도 단결권을 누리지 못한다고 지적하고 있다. 헌법에서 언론, 출판, 집회, 결사 자유를 보장하고 노동 3권을 보장하고 있지만 현장에서는 단순 선언에 불과할 만큼 효과가 없다는 것이다.

ILO는 노조전임자 제도에 대해서 전임자에 대한 임금 지급을 노사자율로 결정하도록 두고 법으로 금지하지 말라고 수차례 권고했지만 우리나라 노조법은 이를 금지하고 처벌 규정을 두고 있고, 파업 문제에서도 정리해고나 노동정책 등은 경영상 이유라며 아예 파업 자체가 불가능하다는게 노동계의 주장이다.

문재인 정부는 4개 협약을 비준에 대해 국정과제로 발표하고, ILO 창립 100주년이 되는 2019년 협약 비준과 각종 법 개정을 한다는 계획이다. ILO 협약을 비준할 경우 현재 공무원, 교사 등의 단결권, 단체행동권 등 노동조합 활동을 일부 제한하는 현행 노동법에 대해서는 전면적 수정이 불가피할 전망이다.

노동계는 문재인 정부가 핵심협약 비준을 공약으로 제시했기에 지금 당장 시작해야 하며 2019년까지 비준을 하겠다는 건 이해할 수 없다고 비판하고 있다.

민노총의 노사정위원회 복귀문제도 현안이다.
주한미국대사관의 밥 암스트롱 정치담당관은 2007년 6월 한국노동사회연구소 이원보 이사장과의 심층 인터뷰를 통해 당시 한국 노동계의 상황과 미래를 진단한 바 있다. 당시 노동계의 투쟁 방향은 10년이 지난 오늘날까지도 그 맥을 이어오고 있는 상황이다.

■ 한국 노동계 투쟁의 과거와 미래

한국노동사회연구소 이원보 이사장은 5월 23일 정치 담당관과의 회동에서 한국의 노동조합 지도자들이 계속해서 구속되지만 한국 경찰이 합법적 이유로 (구속)한다는 것을 마지못해 인정했다고 말했다.

지난 20년 동안 한국의 노동법은 중대한 변혁을 겪었지만 노동조합은 진전되는 정도에 대해 불만을 유지하고 앞으로도 더 많은 변화를 계속해서 요구할 것이다.

그에 따르면, 사람들이 노동법은 충분히 노동자를 보호하지 못한다고 인지하는 한 조합은 충분히 알려지지 않은 문제들에 주의를 끌기 위해 평상의 시위 형태로써 파업과 데모를 사용할 것으로 보인다.

이 이사장은 가장 큰 노동조합인 민주노총이 파업에 대한 경향을 피하지 않을 것이라고 주장했다. 이는 올해 1월에 새 노조 지도자가 취임했을 때 언론에 널리 보도된 내용과는 대비된다. /요약

▶한국노동사회연구소의 임무

1987년 한국의 민주화가 공식적으로 시작되기 전 년에 형성된 한국노동사회연구소는 교육기관에서 싱크탱크로 탈바꿈했다.

김금수(현 한국노동사회연구소 소장)과 천영세(현 민주노동당 대표)를 포함하여 몇몇 주요 노동운동 지도자들에 의해 설립된 한국노동사회연구소는 원래 한국노동교육협회로 명명되었었다.

원래의 사명은 노동 운동의 시대를 시작할 새로운 노동조합의 간부를 교육하는 것이었다. 그들의 노력은 1987년 노동자 대 투쟁에서 정점을 찍었다.

1995년 5월, 한국노동교육협회는 방침을 연구 쪽으로 전환하고 한국노동사회연구소가 탄생했다.

우연찮게도, 한국에서 두 번째로 큰 노동조합인 전국민주노동조합총연맹은 6개월 후인 1995년 11월 한국노동사회연구소 지도자들의 강력한 지지를 받으며 형성되었다. (참고: 가장 큰 노동조합인 민주노총, 한국노동조합총연맹(FKTU)는 1961년 9월에 설립됐다. )

노동조합 운동이 고용주들로부터 더 많은 권익을 보장해내고 더 중요하게는 정부로부터 종합적인 입법을 보장해내며 좋은 진전을 만들어낸 가운데, 한국노동교육연합에서 한국노동사회연구소로의 변화는 노동조합원들의 새로운 요구를 더 잘 부응할 수 있게 되었다.

학자들은 직원에 추가되었고 초점은 구성원들에게 서로의 관심사에 대한 일반적인 이슈를 알리고 중앙 정부에 새로운 노동 정책을 제시하는 것으로 옮겨졌다.
한국노동사회연구소는 회원들의 회비와 교구 판매로 얻은 수익을 통해 기금을 마련한다.

한국노동사회연구소는 보고된 바로는 800명의 회원이 있고 시민사회 단체, 학자, 변호사로 대표되는 40명의 자문위원들이 운영하고 있다.

▶노동자 대투쟁

1987년의 노동운동은 동년의 민주화 운동과 강한 연관성을 가지고 있다.

이러한 정치적 민주화의 맥락에서 노동 운동과 야당이 기존의 권위주의 노동 통제를 위한 법적 틀을 개혁하라는 압력에 직면한 정부는 1987년 11월 노동조합법을 개정했다.

새로 개정된 노동조합법은 기존에 있던 요구와 노동 조합에 대한 다양한 제한을 폐지함으로써 노동자들의 권리를 증진시켰다.

그러나 개정된 법이 복수 노조의 설립을 금지했기 때문에 자택에서의 노조 활동가와 국제 노동 단체들에 의해 그 후 10년간 가혹한 비판을 받았다.

노동자들은 이 새로운 노동 자유의 시대를 전례 없는 노조 가입률을 보이며 환영했다. 노조 가입률은 1985년 12.4%에서 1989년 18.6%로 증가했다.
파업 건수도 이 시기에 1987년 7월부터 9월 사이에만 3,500건 가량으로 늘어났다.

▶노사관계: 1987-1997

한국노동사회연구소의 통계에 따르면 1987년에서 1996 사이에 노조 간부가 구속되거나 기소되었다. 이러한 구속의 가장 흔한 근거는 제 3자 조항 위반, 사업 방해 및 중재 의무 불이행이다.

제 3자 조항은 제 3자인 단체 또는 개인이 고용주와 고용인 사이의 분쟁에 간섭하지 못하도록 규정한다.

당시 정부는 많은 노동 조합들과 인권 단체들이 여러 문제들을 해결하기 위해“무책임한” 행동을 했기 때문에 따라서 그 법안은 논쟁의 여지가 있는 노동 상황에서 중재하는 모든 외부의 압력을 배제할 수 있도록 만들어졌다.

10년 동안의 압박과 노조 간부들의 구속에 대한 광범위한 언론 보도 이후 한국 정부는 1997년 3월 노동 조합 및 노동 관계조정법을 통과시켰다.

이 법안은 노사 관계와 노동 시장을 관리하기 위한 현존하는 법적 구조의 실질적이고 전면적인 개혁이었다.

이 법안은 복수 노조 설립을 허용하고 노조의 정치 활동과 제 3자 개입을 금지하는 조항을 삭제하고 2002년부터 정규직 공무원들에게 임금 지급을 시작했다.
(참고: 2010년까지 법안이 다시 한 번 연기됨에 따라 복수 노조와 임금 지급 문제가 논쟁의 요점으로 남아있다. 참고 끝.)

한국노동사회연구소의 이씨에 따르면 제 3자 개입을 금지하는 조항이 폐지된 후에도 경찰들은 계속해서 노조 간부들을 다른 혐의로 구속했다. 간부들은 주로 중재 의무 위반 또는 사업 방해로 계속해서 구속되었다.

또한 경찰들은 공공장소에서 시위에 참여하는 노조 간부를 체포하기 위해 무단침입과 교통 위반과 같은 더욱 일반적인 조항을 이용하기 시작했다.

▶노사관계: 1997-현재

한국노동사회연구소는 평균적으로 200명 이상의 노조 간부들이 1997년부터 구속되어 왔다고 덧붙였다.

지난 10년간에 비해서는 살짝 낮지만 이씨는 노조 간부들의 구금은 계속해서 그의 단체와 노동조합 총연맹에게 심각한 우려가 되고 있다고 말했다.

이씨는 경찰이 일반적으로 행동이 평화롭다면 불법 시위 또는 파업에 참가한 노조 간부를 구속하는 것을 삼갔다는 언론 보도가 옳았다고 인정했다.

또한, 경찰은 실제로 시위에 참여한 사람보다는 폭력적인 시위를 주도한 노조 간부를 체포하려는 경향이 있었다.

이것에 대한 예시가 노조 간부가 불법 병원 파업을 주도하고 중재 의무 불이행으로 구속되었던 2003년에 일어났다.
수많은 병원 노동자들도 파업에 참가했지만, 노조 간부들만 체포되었다.

▶왜 노조가 시위하는가

이 이사장에 따르면, 노동 조합들은 몇몇 다른 이유로 시위를 했다고 한다. 일부는 그 원인이 내부의 작업장과 노동자에게 있었지만, 다른 것은 외부의 요소나 초점을 가지고 있었다.

지난 20년 간의 노동 투쟁에서 노조 봉기가 일어난 데 대해 가장 흔하게 들어졌던 이유는 고용주에 대한 신뢰의 결여와 노동자들의 불만 사항에 대한 한국 정부의 대응 부족이었다.

이씨의 주장으로는 대부분의 시위가 대내적으로 노동 환경 또는 특정 작업장에서의 노동 문제와는 반대로, 외부적으로는 한국 정부와 노동 정책 전반에 집중되어 있었다.

▶전국민주노동조합총연맹의 미래

정치담당관은 전국민주노동조합총연맹의 미래는 무엇인지, 그리고 한국 정부와의 상호작용의 주요 방법으로 파업에 덜 의존할 가능성에 대해서 질문했다.

이씨는 전국민주노동조합총연맹의 새 위원장이 이전의 위원장에 비해 온건하다고 해도, 앞으로 다가올 7월 연간 임금 협상 기간에서 파업 가능성이 여전히 남아 있다고 말했다.

전국민주노동조합총연맹 위원장 이석행이 파업 여부에 대한 결정을 가볍게 여기지 않겠다던 공개 성명(서울 306호)에도 불구하고 그의 주장에 이르면 더 잘 준비하고 파업을 시행하기 이전에 전국적인 민주노총 관계자들의 더 많은 지지를 얻은 집회를 하도록 노력할 것이다.

좀 더 회유적인 노선을 따라서, 이씨는 명백히 연줄을 넓히고 관계에 영향을 주기 위해 몇몇 정부 부처(소위 건설부와 교통부)와 계속해서 긴밀한 관계를 구축하려고 노력하고 있다.

▶2010년 노동 개혁의 영향

2006년 12월 국회 노동위원회가 복수 노조 이행과 노조 간부의 직접 급여 금지를 2010년까지 연기시키는 것을 포함하여 몇몇 법안을 통과시켰다.

법안이 발효되면 한국 노동 시장은 꼭 필요하게 될 어려운 조정은 제대로 처리할 수 있는 준비가 되지 않았기 때문에 지연은 정당했다.

노동부가 그 법안의 영향을 최소화하기 위해 노력한다던 보도에도 불구하고, 이씨는 법안이 효력을 발휘할 때 광범위한 혼란이 있을 것이라고 말했다.

아직 대답을 듣지 못한 질문 중 일부는: 어떻게 복수 노조가 그들의 집단적 교섭을 정리할 것인가? 노조는 어떻게 노조 간부들의 막대한 임금을 지불할 것인가?

이씨에 따르면, 한 가지 효과는 지역적 또는 산업 기반의 조합들에 대한 더 강력한 동향과 직장 기반 노조의 계속되는 침식이 될 것이다. 또한 정부가 노동계와 어떻게 상호작용할 수 있는지도 밝혀졌다.

한국 정부가 유연성과 안정성, 또는 “유연 안전성” 사이의 올바른 균형을 찾지 못한다면, 이씨는 노동자들이 새로운 협의에 불만을 표하는 목소리로서 더 잦은 파업과 시위가 있을 것이라고 예측했다.

▶논평
한국노동사회연구소와 이씨의 주장이 노조와 긴밀히 연계되어 있지만 그의 견해는 노조가 종종 대사관 직원들과 만나기를 꺼리는 것을 생각해보면 그들이 통찰을 제공한다는 데 유용하다.

특히 덧붙인 것은 노조 간부들은 보통 날조된 혐의에 대비되는 합법적인 법적 근거로 체포된다는 이씨의 시인이다.

지도자로서 광범위한 노조 가입을 위해 노조 간부들은 자신들의 처지에 대한 관심을 증진시키는(때로는 그들을 감옥으로 오게 하는)계속해서 공동 행동(시위, 집회, 파업)을 추구할 가능성이 높다.

많은 노조 간부들은 이것이 노조 내에서의 리더 지위와 함께해야 할 의무이며 체포 또는 범죄 기록에 대한 유보가 없기 때문에 이것이 모든 수준의 한국 사회 지도자들의 용기 있는 증표라고 생각한다. /버시바우

SUMMARY

(SBU) In a meeting with poloff on May 23, Korea Labor & Society Institute Chairman Lee Won-bo said that labor union leaders in Korea continue to be arrested, but reluctantly conceded that police had legitimate reasons for doing so.


Although Korea's labor laws have undergone some serious reform in the past two decades, labor unions remained dissatisfied with the amount of progress and would continue to demand further changes.

According to Lee, as long as people perceive that labor laws do not adequately protect the worker, unions were likely to use strikes and demonstrations as common forms of public protest to draw attention to otherwise under-publicized issues.

Lee also opined that even the largest labor union umbrella organization would not shy away from its propensity for strikes; contrary to what was widely reported in the media when the new union leader took office in January of this year. END SUMMARY.

 


 

KLSI'S MISSION

(SBU) Formed in the year before Korea's democratization officially began in 1987, the Korea Labor & Society Institute (KLSI) has transformed itself from an education center to a think-tank.

Formed by several key leaders in the labor movement including Kim Keum-soo (current President of KLSI) and Chun Young-se (current General Secretary of the Democratic Labor Party), KLSI was originally named the Korea Labor Education Association (KLEA).

The original mission was to educate a new cadre of labor union officials to begin an era of labor movements.

Their efforts culminated in the "Great Worker's Struggle" of 1987.

(SBU) In May 1995, KLEA shifted gears toward research and KLSI was born.

Not coincidentally, the second largest trade union organization in Korea, the Korean Confederation of Trade Unions (KCTU) was formed six months later in November 1995 with the strong support of KLSI's leaders.
(Note: The largest trade union umbrella organization, the Federation of Korean Trade Unions, or FKTU, was formed in August 1961. End note.)

With the labor union movement making good strides to secure more rights from employers and more importantly to secure more comprehensive legislation from the government, the change from KLEA to KLSI was made to better serve the new demands of the labor union members.

Scholars and academics were added to the staff and the focus shifted to informing members about general issues of mutual concern and proposing new labor policies to present to the central government.

KLSI is funded through member dues and revenue obtained from sales of educational materials.

KLSI has a reported 800 members and is managed by a 40-person board of advisors representing a cross-section of civil society groups, academics and lawyers.

 

 

 

 


THE GREAT LABOR STRUGGLE


  1. (SBU) The labor movement of 1987 had strong connections to the democracy movement of the same year.
  2. In this context of political democratization, the government, which faced strong pressures from the labor movement and opposition parties to reform the existing legal framework for authoritarian labor control, revised the Trade Union Act in November 1987.

The revised Trade Union Act promoted workers' rights to organize by abolishing existing requirements and various restrictions placed on labor unions.

However, since the revised law prohibited the establishment of multiple unions, it was harshly criticized for the following ten years by union activists at home and by international labor organizations.

 


  1. (SBU) Workers welcomed this new era of labor freedom by joining labor unions at an unprecedented rate. Unionization rates increased from 12.4 percent in 1985 to 18.6 percent in 1989.
  2. The number of strikes also jumped during this period with approximately 3,500 labor conflicts between July and September 1987 alone.
  3. LABOR RELATIONS: 1987-1997
  4. (SBU) According to KLSI's statistics, between 1987 and 1996, 2,807 union officials were arrested or indicted.

The most common grounds for these arrests were violation of the third party provision, obstruction of business and failure to comply with compulsory arbitration.

The third party provision stipulated that a third party organization or individual could not interfere in a dispute between an employer and an employee.

At the time, the government felt many labor unions and civil right's groups acted "irresponsibly" in these matters and therefore the legislation was designed to exclude all outside forces from intervening in contentious labor situations.

 

(SBU) After a decade of pressure and extensive media coverage of the arrest of union officials, the ROKG passed the Trade Union and Labor Relations Adjustment Act in March 1997.

 

This law was a substantial and full-scale reform of the existing legal framework to administer industrial relations and labor markets.

The Act allowed the establishment of multiple unions, removed the provision banning unions' political activities and third party intervention and prohibited wage payments to full-time union official beginning in 2002.

(Note: The multiple union and wage payment issues remain points of contention as the enactment was once again postponed until January 2010. End note.)

 

 


LABOR RELATIONS: 1997-PRESENT

(SBU) According to KLSI's Lee, even after the provision banning third party intervention was repealed, police continued to arrest union officials on other charges.

Officials continued to be arrested primarily on the grounds that they violated the terms of compulsory arbitration or obstructed business.

Additionally, police began to use more common provisions such as trespassing and traffic violations in order to arrest union officials participating in demonstrations in public areas.

KLSI noted that, on average, more than 200 union officials have been arrested every year since 1997.

Although slightly lower than the previous decade, Lee said the detention of union officials continues to be a serious concern for his organization and the trade union umbrella organizations.

 

(SBU) Lee conceded that media reports were correct in reporting that police generally refrained from arresting union officials who participated in illegal demonstrations or strikes as long as their actions remained peaceful.

 

 

Additionally, police tended to arrest union officials responsible for organizing violent protests rather than the actual participants of the protests.

An example of this occurred in 2003 when union officials responsible for organizing an illegal hospital strike were arrested for failing to comply with compulsory arbitration.

Although numerous hospital workers also participated in the strike, only the union officials were arrested.

 

 

 


WHY UNIONS PROTEST

(SBU) According to Lee, labor unions protested for several different reasons.

Although some of the causes were internal to the workplace and the worker, others had an external element or focus.

In the past 20 years of labor struggles, the most commonly cited reasons for union uprisings were lack of good faith on the part of the employer and a lack of responsiveness by the ROKG to the complaints of workers.

In Lee's opinion, the majority of demonstrations focused externally at the ROKG and labor policies in general as opposed to internal working conditions or labor issues of a specific workplace.

 


 

FUTURE OF KCTU

(SBU) Poloff inquired what the future of the KCTU was and the probability that it would rely less on strikes as the predominant method of interaction with the ROKG.

Lee said that although the new president of KCTU was more moderate that past presidents, there remained a strong likelihood of strikes in the upcoming annual wage negotiation period in July.

Despite public statements by KCTU's president Lee Seok-haeng that he would not take lightly the decision of whether or not to hold a strike (Seoul 306), he allegedly meant that he will be better prepared and will work to rally more support from KCTU affiliates throughout the country before launching a strike.

Along a more conciliatory line, Lee apparently continues to try to build closer relationships with several government ministries (namely the Ministry of Construction and the Ministry of Transportation) to broaden his contacts and influence within official circles.

 

 

 

 


IMPACT OF LABOR REFORMS IN 2010

(SBU) In December 2006, the National Assembly's Labor Committee passed several bills, including a delay in the implementation of multiple unions and the ban on direct pay of union officials until 2010.

The delay was justified on the grounds that Korea's labor market was not suitably prepared to handle the tough adjustments that will be necessary once the laws go into effect.

Despite reports that the MOL is working to minimize the impact of the laws, Lee said that there will be widespread confusion when the laws take effect.

Some of the questions that remained unanswered were: How will multiple unions organize their collective bargaining actions?

How will unions finance the hefty payroll of union officials?

According to Lee, one effect will be a stronger trend toward regional or industrial-based unions and a continued erosion of workplace-based unions.

It also remained to be seen how the government will interact with labor groups.

If the ROKG cannot find the correct balance between flexibility and security, or "flexicurity", then Lee predicted that there will be even more strikes and protests as workers voice their discontent with the new arrangement.

COMMENT

  1.  particular note was Lee's admission that union officials were normally arrested on legitimate legal grounds as opposed to trumped up charges.

    As torch-bearers for the broader union membership, union officials are likely to continue to pursue public actions (demonstrations, protests and strikes) that will draw increased attention to their plight; actions that may often land them in jail as well.

    Many union officials feel this is an obligation that goes along with their leadership position in the union and do not have reservations about arrest or a criminal record as these are looked upon as badges of courage among leaders at all levels of Korean society.
