위키리크스 설립자 줄리안 어산지의 변호팀이 지난 27일 웨스트민스터 법원에서 열린 심리에서 미국 측이 어산지 송환 사건을 정치적 목적으로 이용하고 있다는 주장을 제기했다.

어산지의 변호사 에드워드 피츠제럴드는 이날 심리에서 미 대통령 도널드 트럼프가 피고 측 주장에 대해 ‘민주당의 술수’라고 표현한 사실을 들었다.

피츠제럴드는 미 법무부 장관 윌리엄 바가 최근 갑자기 어산지의 변호팀에게 새로 대체된 기소장을 내세웠고, 이를 정치적 목적으로 이용하고 있다고 말했다.

영국이 어산지의 미국 송환을 확고히 하려고 하기 시작하고 몇 달 뒤 이 기소가 나왔다는 것이다.

또한 피츠제럴드는 미 국무부 장관 마이크 폼페이오가 어산지 사건을 정치적으로 이용하고 있을 수 있다고도 말했다.

현재 런던 벨마시 교도소에 수감 중인 어산지는 이번 심리에서 화상연결로 법원에 출두했다.

피츠제럴드는 심리에서 새 기소로 인해 공판이 11월 미 대선 후로 연기된다면 이는 부당한 일이라고 말했다.

지난 해 4월에 체포된 어산지는 2012년부터 런던 주재 에콰도르 대사관에서 망명 생활을 하고 있었다. 에콰도르가 그의 망명 지위를 철회한 뒤 체포됐는데, 에콰도르 대통령 레닌 모레노는 계속되는 국제조약 위반과 일상 생활의 침해로 어산지에 대한 에콰도르의 인내심이 한계에 달했다고 말했다.

어산지는 2018년 3월 미국으로부터 컴퓨터 해킹 공모 혐의로 한 건의 기소를 받았다가 5월 방첩법 하에 17건의 기소가 추가됐다. 그는 전직 미군 정보분석가 첼시 매닝과 공모해 기밀 문서들을 입수하고 공개한 혐의를 받고 있다. 

18건의 기소 각각에 대해 최고 10년형을 선고 받을 수 있다고 한다.

최근 새로 대체된 기소장은 어산지가 위키리크스의 정보 수집을 위해 국제적인 해킹단체 어나니머스(Anonymous)와 룰즈섹(LulzSec)으로부터 해커들을 모집했다고 주장하고 있다.

미 법무부는, 지난 달 발부된 새 대체 기소장이 이전 18건의 기소에 추가되는 것은 아니지만, 이전에 어산지에게 고발된 컴퓨터 해킹 혐의 의혹의 범위를 더 넓혀줄 것이라고 말했다. 

위키리크스의 편집장 크리스틴 흐라픈손은 이번 새 기소장에 대해 새로운 고발은 없다면서 ‘10년 동안 먼저 나아갔음에도 미 검찰은 여전히 논리적이고 납득이 되는 사건을 세우지 못했다. 그래서 이전의 두 기소를 버리고 세번째로 간 것이다’라고 말했다.

정식 송환 공판은 코로나19로 인해 9월로 연기됐다. 담당 판사 바네사 바레이서는 9월 공판에는 양측 모두 직접 법정에 출석하기를 기대한다고 말했다.

The defense team for WikiLeaks founder Julian Assange alleged Monday during a court hearing that U.S. officials may be using his extradition case for political ends.

Edward Fitzgerald QC said at the hearing at Westminster magistrates court that President Donald Trump had described the defense case as a "plot by the Democrats."

He added that U.S. Attorney General William Barr of the Department of Justice had "sprung" a new superseding U.S. indictment on the defense team and may be using the case for political ends. 

The indictment came months after Britain had started to try to secure his extradition to the United States.

Fitzgerald also said that U.S. Secretary of State Mike Pompeo could be using Assange's case for political purposes, ComputerWeekly.com reported.

Assange, who is being held at Belmarsh Prison, eventually took part in the hearing by video link after an initial delay.

Fitzgerald said at the hearing that it would be improper if the new indictment led to postponing the hearing until after the November presidential election in the United States.

Assange was arrested in April of last year. He had been living in the Ecuadorian Embassy in London since 2012 when he sought asylum to dodge sexual assault charges in Sweden. Assange was arrested after Ecuador withdrew its offer of asylum. Ecuador's President Lenin Moreno said the country's patience for Assange had "reached its limit" after "repeated violations to international conventions and daily life."

The WikiLeaks founder was indicted on 17 new charges of violating the Espionage Act in May of last year and already faced a charge from March 2018 of conspiring to commit unlawful computer intrusion, which carried a maximum five years in prison. Assange was accused of working with former intelligence analyst Chelsea Manning to obtain and publicly release classified information. 

The new charges brought his total charges to 18 counts with each violation of the Espionage Act carrying a maximum 10-year sentence.

The newest superseding indictment alleges Assange recruited and intentionally worked with hackers from hacking groups "Anonymous" and "LulzSec" to provide WikiLeaks with documents.

The Justice Department said the newest superseding indictment returned last month does not add to the 18-count indictment against him in May 2019, but does "broaden the scope of the conspiracy surrounding alleged computer intrusions with which Assange was previously charged."

"It contains no new charges," WikiLeaks editor-in-chief, Kristinn Hrafnsson said outside the court, referring to the new indictment. "What's really happening is despite its decade-long head-start, the prosecution are still unable to build a coherent and and credible case. So they've scrapped their previous two indictments and gone for a third try."

The full hearing of the extradition case has been postponed because of the COVID-19 pandemic to September. Judge Vanessa Baraitser said that she expected all parties to attend in person in September.
