'Samsung is different from other companies'
It is a vague criterion that the special investigator put out to Samsung in the trial for the Choi Soon-sil scandal. Such an approach that was particularly strict to Samsung has been more widespread since the verdict of probation for Lee Jae-yong, the Vice Chairman of Samsung Electronics.
Not only the prosecution but also government departments and political circles seem to be obsessed with taking Samsung down.
Indiscriminate attacks on Samsung such as allegations of accounting fraud in Samsung BioLogics, false appraised value of land of Samsung Everland, and union busting in Samsung Electronics Service are continuing. Samsung Electronics has been under search and seizure nine times this year alone.
It is even pointed out that branding Samsung as a deep-rooted evil company on the back of pubic opinions is actually a part of pre-arranged targeted investigation.
It seems that cleansing deep-rooted evil of the past regimes and the arrow of reform, tasks of the Moon Jae-in regime, are directed irrelevantly to Samsung.
The problem is that most of recent allegations appear to be based on the double standard and focused only on unsettling Samsung via media manipulation before legal judgement.
The recent controversial issue of accounting in Samsung BioLogics is a representative case. The Financial Supervisory Service changed its verdict to ‘accounting fraud’, which increased the controversy of a double standard.
The financial authority did not raise any issue when Samsung BioLogics was listed in the stock market in 2016, but changed its conclusion now after 2 years of time.
It is the reason for a suspicion that Samsung BioLogics has been chosen as a scapegoat for attacking Samsung.
From this point of view, an allegation of ‘union busting’ in Samsung Electronics Service is not much different. The prosecution secured 6,000 documents related to union busting, and launched a full investigation on Samsung Electronics Service. However, it requested arrest warrants for the executives of the company only after a few sessions of search and seizure.
On May 31 2018, the court refused to issue the warrant to the prosecution based on its judgement that the arrest of the CEO of Samsung Electronics Service could be contested. Then, the prosecution requested the arrest warrant again by adding an allegation of tax fraud of 1 billion won.
In addition, the Ministry of Land, Infrastructure and Transport has requested an investigation to the prosecution regarding the Samsung Everland's appraised land price issue, and the Ministry of Employment and Labor also demanded disclosure of its semiconductor processes.
These full range attacks are deepening Samsung's plight. Because its business activities have shrunk significantly and it is not easy to raise its voice due to deteriorating public opinions.
Besides, there is a warning sound from the global competitiveness. The market shares of main products excluding semiconductors are falling.
Samsung Electronics' share of the TV market is 20.1%, down 1.3% from the previous year while that of Samsung Display has fallen to 13.2% in the first quarter of this year from 20% in 2015.
Its market share also has dropped to 18.1% in the smartphone market in the first quarter of this year from 22.4% in 2014
The decline in the market share was attributed to the large increase in China's industrial investment. There are fears that it may be difficult to recover the market share as China is increasing its influence with the price advantage.
A source from the business community said "beating companies using media in the absence of legal grounds doesn’t really help the national economy", and "Companies' activities will be slowed further as competitors grow rapidly".

한국 검찰의 도 넘은 삼성 공격… 이중잣대-여론몰이 문제 제기
특검이 최순실 국정농단 사태와 관련해 진행된 재판에서 삼성에 들이민 애매모호한 잣대는 '삼성은 다르다'는 것이었다. 삼성에만 유독 엄중했던 이런 접근은 이재용 삼성전자 부회장의 집행유예 판결 이후 더욱 확산되는 양상이다.
검찰은 물론 정부 부처, 정치권까지 가세하며 삼성 엮기에 혈안된 모습을 보이고 있어서다.
삼성바이오로직스 분식회계를 비롯해 삼성에버랜드 공시지가 의혹, 삼성전자서비스의 노조와해 의혹 등 삼성 계열사에 대한 무차별적인 공세를 벌이고 있다. 삼성전자는 올해 들어서만 9번이나 압수수색을 당했다.
오죽하면 국민 여론에 편승해 삼성을 적폐기업으로 몰아가는 것은 물론 사실상 표적을 정해 놓고 수사를 벌이는 것 아니냐는 지적이 제기된다.
문재인 정권이 과제로 내세운 구 정권의 적폐청산과 개혁의 화살이 엉뚱하게도 삼성을 향하는 비정상적인 양상을 보이고 있어서다.
문제는 최근 제기되는 의혹의 대부분이 삼성에 대한 이중 잣대는 물론 법적인 판단이 진행되기 앞서 여론몰이식 삼성 흔들기에만 집중되고 있다는 점이다.
최근 논란에 휩싸인 삼성바이오로직스의 회계 처리 문제가 대표적이다. 금융감독원은 삼성바이오로직스 상장 과정을 '분식회계'로 번복하며 이중잣대 논란을 키웠다.
금융당국은 지난 2016년 삼성바이오로직스가 유가증권시장에 상장할 당시만 해도 별다른 문제를 제기하지 않았지만 2년이 지난 지금에 와서야 결론을 바꿨다.
일각에서 삼성바이오를 삼성 때리기의 희생양으로 삼은 것 아니냐는 의혹이 나오는 이유다.
이런 관점에서 보면 삼성전자서비스의 '노조 와해' 의혹 역시 별반 다르지 않다. 검찰은 '노조 와해' 관련 문건 6000건을 확보하고 삼성전자서비스에 대한 수사에 본격 착수했지만 수차례 압수 수색을 진행한 이후에야 임원들 구속영장을 청구하기도 했다.
지난달 31일에는 법원이 삼성전자서비스 대표에 대해 다툼의 여지가 있다며 검찰의 구속영장 청구를 기각하자 10억여원의 조세범처벌법 위반 혐의까지 추가해 구속영장을 재청구했다.
이 밖에도 국토교통부는 삼성 에버랜드의 공시지가 문제와 관련해 검찰에 수사를 의뢰했으며 고용노동부는 반도체 공정의 공개를 요구하기도 했다.
이처럼 전방위적인 공격에 삼성의 속앓이도 깊어지고 있다. 기업활동이 크게 위축된데다 악화된 여론 탓에 목소리를 내기 쉽지 않기 때문이다.
여기에 대외적으로는 글로벌 경쟁력에서 경고음 마저 울리고 있다. 반도체를 제외한 주력제품의 시장 점유율이 떨어지고 있는 것.
삼성전자의 TV 시장 점유율은 지난해보다 1.3%포인트 떨어진 20.1%를, 디스플레이는 지난 2015년 20%에서 올해 1분기 13.2%까지 낮아졌다.
스마트폰 시장에서도 지난 2014년 22.4%에서 올해 1분기 18.1%로 낮아졌다.
점유율 하락은 중국의 산업 투자가 크게 확대된데 따른 것으로 분석됐다. 가격 우위를 앞세워 영향력을 점차 높여나가고 있는 만큼 점유율 회복이 어려울 수 있다는 우려까지 나오고 있다.
재계 관계자는 "법적 근거가 없는 상황에서 여론몰이식 기업 때리기는 국가 경제에도 도움이 되지 못한다"며 "경쟁 기업들이 빠르게 성장하는 상황에서 기업들의 활동은 더욱 위축될 수 밖에 없을 것"이라고 말했다.
