줄리안 어산지팀의 건곤일척(乾坤一擲) 대결전이 시작됐다.

줄리안 어산지(47)의 미국 송환을 둘러싼 법률 공방이 본격화 하고 있다.  가디언에 따르면 <위키리크스>의 편집장 크리스틴 흐라픈손은 영국 법원의 투옥 결정에 격하게 반발하며 ‘분노’를 금할 수 없다고 말했다. 아울러 그는 어산지의 미국 송환을 두고 벌어질 웨스트민스터 치안법원에서의 청문회는 ‘대격전(big fight)’의 시발점이 될 것이라고 강조했다. 그는 이 싸움을 두고 "어산지의 생사가 걸린 중차대한 문제가 될 것"이라고 예상하기도 했다.

담당 판사는 변호인단이 제출한 어산지에 대한 정상참작 요인들을 대부분 기각했다. 이보다 앞서 줄리안 어산지는 성폭행 혐의 때문에 스웨덴으로 강제 송환되는 상황을 피하기 위해 2012년 런던 주재 에콰도르 대사관으로 피신했었다. 하지만 어산지는 이 혐의를 부인하고 있다.

판사는 어산지가 보석 조건을 위반한 사항을 두고 "이보다 더 엄중한 범죄를 찾아보기 힘들다"는 말도 했다.

“피고는 (에콰도르) 대사관에서 거의 7년이나 머물면서 특권을 이용해 법을 업신여기고, 국제적으로 이 나라의 법을 모욕했다.”

담당 판사인 데보라 테일러는 사우스워크 형사법정에서 판결을 내리며 이렇게 말했다.

“피고의 행위가 스웨덴 법원의 법 절차 진행에 영향을 미쳤음은 의심할 나위가 없다. 피고가 처음에는 협력을 했다하더라도 조사에 어느 정도 협력해야 하는지 그 정도는 피고가 결정할 일이 아니다. (스웨덴 법원은) 효과적으로 절차를 진행할 수 없으므로 사건을 중지할 수 밖에 없었다. 이러한 결말의 큰 원인은 피고가 (에콰도르) 대사관에 머물고 있었기 때문이다.”

어산지는 에콰도르 정부가 그의 정치 망명을 철회하고, 지난달 런던경찰청 경찰관들을 나이츠브리지(London Hyde Park 남쪽 지역)의 외교가에 있는 대사관 건물에 들임에 따라 체포됐다.

앞서 어산지는 영국 당국에 서신을 보내 자신의 행위들에 대해 반성은 하지만, 자신으로서는 다른 대안이 없었기 때문에 대사관 피신이라는 선택을 할 수 밖에 없었다고 항변했다.

“제가 여러 절차들을 활용해서 (당국을) 업신여겼다고 생각하신다면 진심으로 사과드립니다. 이는 제가 바라는 바나 의도하던 바가 아닙니다.”

어산지는 그의 변호사 마크 섬머스가 대신 읽은 탄원서에서 이렇게 주장했다.

“저는 제 자신이나 제게 조언을 해주는 어느 누구도 뚜렷한 해결책을 찾을 수 없는 공포에 직면해 싸워야 했습니다. 저는 당시로서는 최선이라고 생각되는 선택을 할 수 밖에 없었고, 그 길 외에는 다른 방법이 없었습니다. 저는 그렇게 하면 스웨덴과 에콰도르 정부 간에 법률적 합의가 이뤄져 최악의 상황으로부터 벗어날 수 있을 것이라 희망했습니다.”

콤비 재킷의 검은 상의를 입고, 대사관에서의 체포 당시 길렀던 턱수염을 깎은 어산지는 법정에 서서, 그가 대사관에 계속 머물러있었기 때문에 그를 법정에 세우기 위해 영국 납세자들의 세금 1600만 파운드가 들었다는 소리를 판사로부터 들어야 했다.

“어느 누구도 법 위에 있거나 법을 회피할 수 없다는 것이 법치의 기본 원칙입니다.”

판사는, 어산지의 탄원서가 그가 자신의 행위를 뉘우친다는 최초의 징표라고 밝히며 이같이 말했다.

한편, 담당 판사가 최대 형량에서 불과 2주에 못 미치는 50주 간의 투옥과 함께 4월 11일 체포 후 구금 기간을 총 형량에서 역산하여 감한다는 판결을 내릴 때 방청석에 앉아있던 어산지 지지자들로부터 ‘부끄러운 줄 아시오!’라는 함성이 쏟아져 나왔다.

판결 후 어산지는 법원에서 이끌려나가며 방청석을 돌아보고, 지지자들을 향해 불끈 쥔 주먹을 높이 들어보였다.

 <위키리크스>의 창립자의 변호인은 이보다 먼저 정상참작에 도움이 될 여러 증거들을 법원에 제출했었다. 변호인은 이 증거들에서 어산지가 스웨덴에서 미국으로 송환될지 모른다는 두려움 속에서 지냈으며, 미국의 정치인들은 어산지가 암살당해 마땅하다는 소리를 공공연히 하고 있다고, 주장했다.

또, 첼시 매닝의 경우와 미군 정보의 다른 공익제보자들이 겪어야했던 상황들도 함께 언급되었다. 그들은 스웨덴에서 미국으로 송환되는 과정에서 포승줄에 묶이고, 비행 기간 동안 약물을 주입받아야했다.

마크 섬머스 변호인은, 어산지가 <위키리크스>와 연관된 자신의 행위 때문에 미국 본토나 관타나모 수용소로 이송되어 사형을 언도받을지 모른다는 공포에 사로잡혀왔다고 법원에 호소하였다.

“미국에서 날아드는 위협이 너무도 강력해서 어산지에게 유리한 어떤 가능성도 고개를 들지 못하고 있습니다.”

그는 이렇게 주장했다.

“피고는 공포로 인해 아무 생각도 할 수 없습니다. 이러한 공포는 피고가 촉발한 것들이 아닙니다. 위협에 따른 공포가 피고를 짓누르고 있습니다.”

나아가 변호인은 어산지가 영국 감옥에서의 1년보다 스스로 에콰도르 대사관 내의 협소한 방에서, 우울증과 여러 질병들을 감내하는, 무기한 구금 상태를 선택했던 점이 그의 두려움의 정도를 잘 나타내고 있다고 주장했다.

<위키리크스>의 편집장 크리스틴 흐라픈손은 ‘이번 판결은 보복적 성격이 강하다’고 불만을 제기하며, 향후 벌어질 법적 절차와 관련하여 ‘앞으로의 싸움에서 우리는 영국의 법 절차에 대해 크게 신뢰를 할 수 없다’고 덧붙였다.

변호인은, 쾌속보트 충돌로 여성을 사망하게 한 후 조지아 주로 송환된 잭 쉐퍼드 사건의 선고와 비교하면서 다음과 같이 강조했다.

“비교를 위해 다음 사항을 지적하고 싶습니다. 이른바 쾌속보트 살인사건의 피고는 살인죄의 선고 재판정에 나타나지 않았다고 해서 6개월을 언도받았습니다.”

변호인이 예를 든 사건에서 잭 쉐퍼드는 유죄청원(guilty plea)이 받아들여졌다. 하지만 어산지는 보석 조건 위반 혐의를 부인하고 유죄 판정을 받았다.

A struggle over the US request for Julian Assange’s extradition will open in court on Thursday morning, a day after the WikiLeaks founder was jailed for just under a year for breaching bail conditions to avoid being extradited to Sweden.

Wednesday’s sentence was decried as an “outrage” by Kristinn Hrafnsson, the editor-in-chief of the whistleblowing website, who said the hearing at Westminster magistrates court to oppose Assange’s extradition would be the start of the “big fight” – a process he said would be “a question of life and death for Mr Assange”.

A judge largely rejected the mitigating factors put forward by lawyers for Assange – who took refuge in Ecuador’s embassy to London in 2012 to avoid extradition to Sweden over sexual assault allegations, which he has denied – and told the 47-year-old it was difficult to envisage a more serious example of the offence.

“You remained there for nearly seven years, exploiting your privileged position to flout the law and advertise internationally your disdain for the law of this country,” said Judge Deborah Taylor, as she sentenced him at Southwark crown court.


“Your actions undoubtedly affected the progress of the Swedish proceedings. Even though you did cooperate initially, it was not for you to decide the nature or extent of your cooperation with the investigations. They could not be effectively progressed, and were discontinued, not least because you remained in the embassy.”

Assange, who was arrested last month when Ecuador revoked his political asylum and invited Metropolitan police officers inside the country’s Knightsbridge diplomatic premises, had written a letter in which he expressed regret for his actions but claimed he had been left with no choice.

“I apologise unreservedly to those who consider that I have disrespected them by the way I have pursued my case. This is not what I wanted or intended,” he said in the letter read out by his lawyer, Mark Summers QC.

“I found myself struggling with terrifying circumstances for which neither I nor those from whom I sought advice could work out any remedy. I did what I thought at the time was the best and perhaps the only thing that could be done – which I hoped might lead to a legal resolution being reached between Ecuador and Sweden that would protect me from the worst of my fears.”

Assange, wearing a black blazer and shorn of the beard worn when police carried him out of the embassy last month, was told by the judge that his continued residence there had cost £16m of taxpayers’ money “in ensuring that when you did leave, you were brought to justice”.

“It is essential to the rule of law that nobody is above or beyond the reach of the law,” said the judge, who said Assange’s written apology was the first recognition that he regretted his actions.

The judge was met with cries of “shame on you” from Assange’s supporters in the gallery when she sentenced him to 50 weeks in prison – two weeks short of the maximum under guidelines – and directed that time spent on remand since his arrest on 11 April would count against it. Assange turned and raised a clenched fist to supporters as he was led away.


The WikiLeaks’ founder’s lawyer had earlier laid out a number of mitigating factors, claiming Assange lived in fear of being rendered from Sweden to the US, where politicians had talked of having him assassinated.

The case of Chelsea Manning and the conditions in which the US military whistleblower was kept was also mentioned, as was the case of individuals who were rendered from Sweden to the US in chains and after being drugged for transatlantic flights.


Summers told the court the Australian had been “gripped” by fears that his work with WikiLeaks would provoke rendition to Guantanamo Bay or the US, where he could face the death penalty.

“As threats rained down on him from America, they overshadowed everything as far as he was concerned,” he said. “They dominated his thoughts. They were not invented by him, they were gripping him throughout.”

He said the fact Assange chose indefinite detention in small rooms at the Ecuadorian embassy, in a state of depression and pain for various medical ailments, rather than spend 12 months in a British jail, showed the extent of his fears.

Speaking on the steps of the court afterwards, Hrafnsson said the sentence was vindictive, adding: ““It doesn’t give us a lot of faith in the UK justice system for the fight ahead.”

Drawing a comparison with the sentence of Jack Shepherd, who killed a woman in a speedboat crash and later fled to Georgia, he added: “And may I point out, just in comparison, that the so-called speedboat killer got six months for not showing up in court to hear his sentencing for manslaughter.”

Shepherd was given credit for his guilty plea, while Assange denied the bail offence and was convicted by a court.
