<위키리크스> 설립자 줄리안 어산지의 미국 송환 관련 공판 일정이 둘로 나뉘게 됐다.

25일(현지시간) 로이터통신에 따르면 영국 웨스트민스터 법원의 담당 판사 바네사 바레이서는 두번째 공판을 5월로 연기한다고 밝혔다.

어산지와 미국 측의 청원에 따라 법원은 2월 24일에 시작될 예정이었던 공판을 2월 24일부터 일주일, 5월 18일부터 3주 동안 일정으로 쪼개기로 결정했다.

어산지와 미국 양측 모두 증거를 수집하고 재판에 준비할 시간이 더 필요하다고 주장해왔다. 어산지의 변호인들은 교도소에 수감돼 있는 어산지를 만날 시간조차 주어지지 않고 있다고 호소했다. 어산지는 법원 출두도 대부분 화상연결로 이뤄지고 있는 상황이다.

울위치 법원에서 열릴 2월 공판은 미국의 송환 추구가 정치적인 것이며 절차의 남용이라는 어산지 측의 주장에 대해 다룰 것이라고 한다. 

또한 어산지의 정신적 상태에 대한 의학적 증언도 있을 예정이다.

미국 당국을 대표하는 변호사 클레어 더빈은 어산지 변호팀이 원하는 대로 어산지가 익명의 증인들과 통화할 수 있게 하는 것에 반대한다고 말했다.

<위키리크스>에 미국 기밀 군사 자료들을 공개함으로써 전쟁범죄와 권력의 남용을 밝힌 어산지를 많은 이들이 지지하고 있지만, 미국은 국가안보를 위협했다고 해서 어산지를 위험 인물로 지정했다.

이후 어산지는 스웨덴에서 성범죄 혐의를 받았고, 미국으로의 송환을 피해 2012년 런던 주재 에콰도르 대사관에 들어가 망명을 추구했다. 스웨덴 측은 증거 불충분으로 어산지에 대한 수사를 철회했다.

에콰도르 대사관에서 7년을 보낸 어산지는 지난 해 대사관 건물에서 강압적으로 끌려나와 영국 경찰에 체포됐고, 보석규정 위반으로 50주의 실형을 선고 받았다. 

미국은 정부 컴퓨터 해킹 공조 및 방첩법 위반으로 어산지에게 18건의 기소를 부과했다. 유죄 판결이 날 경우 종신형과 다를 바 없는 실형을 선고받을 수 있다.

바레이서 판사는 재판이 3개월 뒤로 미뤄진 것에 대해 유감스럽지만, 동의할 수 밖에 없음을 표했다. 그러면서 양측이 바뀐 일정을 지켜 준비해야 한다고 말했다.

Extradition hearing for WikiLeaks' Assange to be split in two parts

The London hearing to decide whether WikiLeaks’ founder Julian Assange can be extradited to the United States to face charges including spying will be split in two, with the second half delayed until May, a judge ruled on Thursday.

Assange, 48, faces 18 counts in the United States including conspiring to hack government computers and violating an espionage law. He could spend decades in prison if convicted.

Following applications from Assange’s legal team and lawyers representing the United States, Judge Vanessa Baraitser at Westminster Magistrates’ Court agreed that his extradition hearing would start on Feb. 24 for a week, with the remaining three weeks taking place from May 18.

Both sides in the case argued that they needed more time to prepare for the hearings and gather evidence. Assange’s lawyers said it was hard to speak to their client, who is currently being held at Belmarsh Prison in east London and appeared on Thursday by videolink.

“We simply can’t get in as we require to see Mr Assange and take instructions ... we need time to deal with that,” his lawyer Edward Fitzgerald said.

The first part of the full hearing in February at Woolwich Crown Court will cover arguments that the extradition is politically motivated and an abuse of process.

Clair Dobbin, the lawyer representing the U.S. authorities, said they would oppose allowing Assange to call anonymous witnesses as his legal team intends. The hearing will also hear psychiatric evidence about his mental state.

To some, Assange is a hero for exposing what supporters cast as abuse of power by modern states and for championing free speech. To others, he is a dangerous rebel who has undermined U.S. security by WikiLeaks having published hundreds of thousands of secret U.S. cables.

In 2012, Assange took refuge in Ecuador’s London embassy to avoid extradition to Sweden where he was accused of sex crimes which he denied and which were later dropped, saying he feared he would ultimately be sent on to the United Sates.

After seven years, he was dragged from the embassy in 2019 and jailed for 50 weeks for skipping bail before the U.S. launched its extradition request.

Baraitser was clearly unhappy about the “lengthy” three-month delay to the hearing but reluctantly agreed, telling both sides they would need to stick to the amended timetable.
