Union "Contracts containing toxic clauses violate freedom of choice"
Management said, "Many global companies also sign contracts in equal positions."

The Samba union sent an official letter to Samsung Group Chairman Lee Jae-yong amid complaints from Samsung BioLogics (Samba) employees over forced conversion arrangements and confidentiality contracts.

According to the Samba union on the 18th, it sent a letter of protest to Chairman Lee Jae-yong on behalf of 1,900 members to publicize the company's irrationality.

The complaint said, "In December 2022, we forced the deployment of a large-scale forced conversion named Re-think, and Park Yong, the head of the Human Resources Support Center, said, "We can fire them in the U.S., but we cannot in Korea, so we are giving them another chance." The employees had to move to different departments without sympathizing with each other from selecting programs to training programs."

The letter also said that the existing trade secret protection agreement was recently changed to a confidentiality agreement, and that it is restricting employees from changing jobs by strengthening anti-competition agreements.

The union believes that the leakage of trade secrets can be legally taken due to security violations, and that the inclusion of a ban on competition, which most precedents consider invalid, is intended to limit turnover.

Park Jae-sung, chairman of the union, said, "I would like to ask if it is moral to sign a contract containing a toxic clause that would cause problems if you move to a specific company. Please stop violating the freedom of choice with the provisions of the contract, not improving treatment."

Competitors specified in the contract include Lotte Biologics, Celltrion, and SK Bioscience.

In this regard, Samba explained that changing from a pledge to a contract does not increase the legal effect, and that many global companies are also adopting a method in which companies and executives and employees sign "contracts" on equal footing.

The ban was also included in the existing pledge to protect trade secrets, but recently, some executives and employees have leaked trade secrets such as core technologies, specifying major competitors subject to the ban.

Meanwhile, labor and management of Samba held their eighth round of collective bargaining on the 18th.

The union said that collective bargaining has been broken down due to the management's non-cooperation, and that it will go on strike if it fails to reach an agreement with the management again this time.
